Tax people - question
I am working with a new client who works with non profit business.
She orders "awards" from me (she is a wholesaler). She then resells all of this to an end user.
I am not required to collect tax from her correct? But she says she doesn't have a tax exempt form.
Also I think im good since she is based in NJ and I am in NY. so should have to collect tax anyway.
so confused.
any help would be great

Re: Tax people - question
Do you have a license to collect NY sales tax? Is she picking up from you or are you shipping to her?
If she is picking up from you then you should be collecting sales tax. If she is reselling she should be filing an ST120 with you so that waives your right to collect sales tax on these sales. If you are shipping to her in NJ then you don't need to collect.
I'm no tax expert but that's how I would handle it.
