Car Seat question

My BIL was in an accident a couple weeks ago, thankfully he is OK and even bigger fortunately he did not have his son in the car.
Does he have to replace the car seat even though my nephew was not in the seat at the time of the accident?

Car Seat question

Nothing to do whether or not your nephew was actually in the car, if there was damage to the seat, even minor...absolutely replace it.

In Florida, if you're in an accident and the cops are brought to the scene they automatically confiscate the car seat as an example.

That seems so silly. We were in an accident a few weeks ago with both kids in the car and the cops came - we were able to drive the car so if they took the car seats how would we have gotten the kids home?

He needs to ask the adjuster to look at them when he goes to look at the car. Generally they will replace them to avoid liability if something happens in the future.

It depends on the manufacturer of the car seat. Check the manual and it will say "replace after any accident" if you need to. I know Graco does.

yes and the insurance company will typically pay the replacement cost

britax (not sure if all models) you dont need to replace.
most others you do, even if its a minor bump.

I agree. I always call the cops, even for a fender bender because DH was a cop and says that is best. Just in case there is an issue later- at least you have a police report.
I was in a fender bender 2 years ago-I did not replace the seat.
However, there is a list online somewhere that tells you the guidelines for replacing the seat after an accident.

NHTSA recommends that child safety seats be replaced following a moderate or severe crash in order to ensure a continued high level of crash protection for child passengers.

NHTSA recommends that child safety seats do not automatically need to be replaced following a minor crash.

Minor crashes are those that meet ALL of the following criteria:

The vehicle was able to be driven away from the crash site;

The vehicle door nearest the safety seat was undamaged;

There were no injuries to any of the vehicle occupants;

The air bags (if present) did not deploy; AND

There is no visible damage to the safety seat

Depends on manufacturer. Most say replace no matter what. Britax has guidelines to determine when to replace.
