What Car Seat / booster is your 9 year old using?

Car seat for 9 year old.
I am sorry I have to ask a stupid question but do 9 year olds have to be in a car seat? It is the law or just safer? I just remember when I was 9 I definitely didn't and I have a almost 9 niece and a 10 niece and they don't have them. Is this illegal?

In NY the law (written 30 years ago and completely outdated) states up to 8 years and 80 pounds should be in a booster. But in regards to safety, children should be in a booster until they pass the 5 STEP TEST There are booster seats that are made for up to 100 pounds and more now ( Boosters are for big kids too ) Proper belt placement is very important in the event of an accident.

What is the child passenger safety law in New York State?
The law requires children under the age of four to be restrained in a federally approved car seat when riding in a motor vehicle [Section 1229-c(1), NYS Vehicle & Traffic Law].
If the weight of a child under the age of 4 exceeds 40 pounds, the child may be restrained in an appropriate child restraint system, allowing the child to use a booster seat. Children ages 4, 5, 6 and 7 must be properly secured in an appropriate child restraint system, one for which your child meets the weight and height recommendations of the child restraint manufacturer. [Section 1229-c(1), NYS Vehicle & Traffic Law] A child safety seat or harness/vest or booster seat may be used. Note: As of November 24, 2009, this requirement applies to all children until their 8th birthday.
The vehicle's safety belts are not defined as a child restraint system under this law, as safety belts are not designed for children under 4'9" and therefore, do not protect young children.

Car seat for 9 year old.
At 9 if they can't pass the 5 step test and don't want to sit in a "baby" booster anymore, look at the Safety 1st Incognito booster.
As ny55angel said, it's a matter of safety. Proper belt placement is vital.
Just because it's legal doesn't mean it is the safest option. Laws have not caught up to the recommendations. (Mostly because recommendations are easier to change than laws..........)
