Lease Question

My husband and I recently signed a lease for a house rental. We were supposed to move in mid March and I just received a call from the owner telling me the house has been sold. The house had been listed prior to us signing the lease but we were told that the listing was expiring this month and it would be pulled so in order to make me feel comfortable the owner singed a one year lease with us. I'm really upset and feel like I was duped somehow. Anyway she's going to send me the deposit back and a "voided" lease. Has anyone ever heard of this? Are they obligated in anyway since the lease was already signed? And if anyone knows of any two or three bedroom apartments or houses for rent that allow pets let me know, LOL.

I'm pretty sure they are obligated to rent to you. I would take them to small claims court

I would read through the lease very carefully to see if there is a clause about either side breaking the lease

You need to see what the lease says. I am not an attorney but IMO she can't just "void" the lease. I am not certain what your recourse is or if you want to pursue legal action. You should consult an attorney to find out what your rights are (most will give you a free consultation).

Thanks, my husband feels that we should just forget it and move on. It just feels so wrong and shady for someone to do that. It just surprised me how misleading people can be.

Thanks but we are looking in Nassau, my husband works in Bethpage so any of the surrounding areas. We are currently in Westbury.

They can't rent a house they don't own so they could rent to you until closing but then the new owner will have you leave.

This isn't true. If there is a lease, the lease carries over to a new owner. Presumably they wouldn't be closing until after the least started, which means that legally you have a right to move in March 1. This assumes that the lease doesn't have some clause that says otherwise, of course.

Practically speaking, it might be better for you to find somewhere else, so as not to have to deal with the stress and an unhappy landlord.

ETA: Even if you moved in, the new owner/ LL will almost certainly not renew the lease (unless they happened to be buying the house for investment purposes, I suppose), so you'd have to move in a year anyway, which is another reason why it might make more sense to find somewhere else.

We rent our condo and have a sell clause in the lease. Read the lease to see. Personally, you didn't move in yet, you didn't occur any moving costs and your getting your money back. Chalk it up to bad luck and just find another place. It's not worth the headache.

I agree 100%.

I have a broker I've been dealing with in Nassau for housing location for some of my clients who is really good. I can give you her contact info if you want it.
