How does the 12 weeks work in regards to days off?

I'm not sure i really understand your question. You get 6w vaginal 8w section of "sick" leave. The remainder is fmla- an additional 6 for vaginal 4 for a section.

No for summer births I was told fmla begins in September you can't be on leave when you're not in session. So week wise I was wondering how they count holidays because Rosh hashana and a few others fall during my leave

fmla is counted by weeks, not school days. so it's 12 calendar weeks from whatever your start date is. then the number of sick days you would need to use are the number of school days during that time.

ooops sorry didn't realize it said doe. im on LI.
either way i know for a fact that fmla goes by calendar weeks not days.
however i have heard conflicting things from friends working for doe that if you have the baby over the summer they may not let you use sick days starting in september.

Even though I did this once before I was and still am confused by the whole process. I can only tell you that they took all of my days in car in addition to fmla. I was knocked off of health insurance as soon as my fmla days were up but I continued to get paid through the summer and then got knocked off of payroll when i came back in September until i repaid the money. Very annoying and confusing - i'm sure this didn't help you at all I'm sorry.

vacations do count towards FMLA (ie: feb break, spring break etc and even single days, but you will not get docked a sick day) Summer does not count for FMLA and FMLA skips over summer and restarts or starts first day of school

You know you shouldn't be docked days while on fmla. They can't not pay you and take your days it's one or the other

Summer Baby = FMLA starting the first day that schools starts. I took Intermittent FMLA meaning I only worked M-W so if a holiday fell on a Thursday or Friday it DID NOT count towards FMLA. However, I don't know how it works if you take FMLA 12 weeks straight. I'm going to go to the Maternity workshop.

Im not sure how it works on FMLA but normally you dont get docked for that day if school is not in session.
