The ER should not have sent you home. I would say they missed it. I wouldn't be as quick as others to let the ped off. You said you went to the ped 1st who I presume listened to your DC's lungs etc. The ped felt you needed to go to the ER I presume since they sent you there. I would think the ped would have been more confident that further evaluations should have been made or why would the ped tell you to go to the ER. So I would be mad at the ER but I would want to know why your ped didn't push harder for further studies. It was good to send you but I wouldn't let the ped off 100%. Did they run any blood work to check for infection? I hate to say it but ERs make mistakes like this all of the time. Very scary. I would write a letter to risk management advising them of this incident and your experience. They might need to review protocols.

Pneumonia wont be seen for a few days on Chest X-ray.

An X-ray is not a treatment, but a diagnosis...

Your kid should have been on antibiotics with such a high fever and low oxygenation. If they were on an antibiotic, a chest x ray doesn't really have to be done.

Hope your kid is feeling better.

I understand what you're saying here and I think at some level the Ped was to lazy to really help, but at the end of the day that child was the hospitals responsibility and the attending dropped the ball. I would contact the ER manager, the hospital administration, the physicians group that doctor works for and see what happens. I would also refuse to pay for the last visit where they finally did the x-ray and confirmed the pneumonia. Had they done that the 2nd time you would not have had a 3rd visit. That is NOT on you. If nothing comes of it I would contact an attorney for a consult. With a 2 year old having increased DIB, an SPO2 at 85% and a fever there is defiantly mismanagement here. Not that it really matters since they have to report to an attending, but it would change things in how I would approach the situation.



There is no malpractice because thank god there was no long term damage.

Also, there is no reason that she shouldn't pay for the ER visit. Even in cases of huge malpractice the hospitals/doctors still get paid. Just isn't the way it works



I disagree. If they had done the 2nd chest x-ray when she asked there would have been no need for a 3rd visit. I don't think it's unreasonable to not pay. I'm not saying just don't pay, but contact the administration and explain you are willing to pay for say the 1st and 3rd visit but not the 2nd since that lead to the 3rd because they didn't do what you asked. It is a readmition into the ER that was unwarranted had they done the right test that 2nd visit.

As for a lawyer....I never suggested anything more then contacting one. Just because it's a doctor doesn't mean they can do whatever they want.

As for that's not how it works. That's not true. I was admitted with gall stones and was to have surgery. They did pre-op blood work and my beta came back + I told them over and over I was not pg...I couldn't be. They refused an OB consult and or to find my beta number. I was sent home. 2 days later I had another attack and they did a beta in the ER. I have an antibody that will test + but my beta was 1. I was infact not ever pg. We contacted the hospital after the surgery and told them the story and that we would not pay for the 2nd readmission and all treatment leading up to my pre-op as that was already done. They said no and when we called that VP we were told the entire visit was washed away because of what happened. That wasn't the intention at all, but you have a right also to be heard and taken seriously and you don't have to just pay for things that should have and could have been prevented. Fight it. There are grievance policy's you can follow.

Does your pediatrician have privleges at that hospital? If so I'd definitely have a chat and I'd write a letter to the medical board and hospital.



Completely agree. My son has asthma and has been hospitalied many times. It is was unacceptable for the hospital to send you home with a stat of 85. I can't believe they let you take a 2 year old home at that level.

Exactly this! With the high fever and the low oxygenation I honestly probably would have declined a chest x-ray and continued with the antibiotics. I would have stayed in the ER until her oxygen levels stabilized. I don't think anyone really dropped the ball besides for the ER for letting you leave with her oxygen levels so low.

I would be angry. My DD is 2 and had pneumonia a few weeks ago. But my ped did the blood, nose swab etc right away. We went back every 2 days until my DD was better. With those oxygen stats and symptoms not clearing up, I would be upset at both the ped and the hospital. Someone should have caught this!

It's a good thing your advocate for your child and trust your instincts and demanded the xray.

See this is what I cant get over...my ped said that she told the attending either to give DD a chest xray or admit her overnight....he discharged me with no X-ray....is the ped lying to cover her ass? did the attending simply ignore her orders?....

I will never know but someone is lying here....

NO defense of the attending, but in this case, how would the treatment have differed had she been diagnosed more quickly? If I was the doctor, I would have prescribed antibiotics on the physical diagnosis and treated for bacterial pneumonia, skipped the xray, and administered oxygen as necessary.

I don't agree with exposing children to radiation from xrays if not absolutely necessary, and in most cases of bacterial pneumonia, if antibiotics that would treat pneumonia are prescribed, there is no real need for the xray.

An x-ray gives a dose of radiation to the person receiving it. Doctors try and limit little children's exposure to radiation, especially because they are growing so fast and we don't really know the full long term effects on the body. Not saying what should or shouldn't have been done but I can see, and appreciate, why a Dr would be more cautious about ordering a second xray.

Pediatrics is hard because a kid's health status can change very quickly, for better or for worse.

OP: I hope your daughter feels better soon!



ITA....my DD just got DX with bacterial pneumonia. Because it was bacterial, she didnt need an xray. My Ped made sure it was bacterial, before sending me for an unnecessary exposure to radiation. I'd rather a finger blood draw, than an xray.

I have only peeked at this, and I know the word "lawyer" has been talked about..in whatever capacity.

I am NOT a lawyer, but just so you all know the definition, or standard of malpractice is: Did the doctor deviate from standard medical procedure.

In what I have read, not really. Is it grey? I am not a doctor. Yes I know a sat level of 85 is not good...but did the ER doctor DEVIATE FROM THE STANDARD OF CARE? Meh. But there was no damage done. It was caught. The little girl will be fine, thank god.

There is no case, IMHO. But again, I am NOT a lawyer (I just know about medical malpractice from eeprience).

I was not referring to medical malpractice when I said that, and even if I was so what. If someone treated my DC that way and I was unsure of the law I would consider it. Getting a consult for whatever reason doesn't mean you are doing anything about it except talking to someone who went to school for the law. Geez I say 1 word and that stirs the pot, but someone let a 2year old go home with a SPO2 of 85% and it's all thank God that she's ok......what about the next kid, that doesn't mean they will be so lucky. At the very least some re-education is needed for that doc. Kids decline fast, and I honestly find that unacceptable. Had I ever blew someone off with those symptoms I would have been fired. Doctors are not God's and they have a responsibility to people.

I am not the one who mentioned didn't a lawyer but I did suggest risk management. I had experience in this area and I can't say they didn't deviate from the standard of care...but forget lawsuit and all of that. I would think there are protocols for a child with low stats, deteriorating health, etc. Okay they didn't do an xray. But the mom said they didn't do any blood work or at least hold this child for a little while for observation. Did they give her oxygen? I would hope the hospital would review their protocols. It doesn't take long to run a blood test or maybe give meds if there is suspicion of an infection. Not sure but she said her ped expected they would either give her another xray or hold her overnight for observation. So I would think if she sent her patient there and figured they would do that - she would probably be under the impression that is what they would normally do with a patient in that condition.

You are right though that a bad out come does not mean malpractice. But I do think if it wasn't a deviation, maybe a dr or nurse on here knows, it IS something that should be reviewed. I am more concerned if they misssed this the next child won't be as lucky. It isn't like ERs are known for their perfect record. They are known for making mistakes, some more than others.

My DD never had bloodwork done....

If there was bloodwork done, they would have picked up the infection and prescribed her antibiotics negating the need for another X-ray ...but that wasnt even done....

See I might feel differently if she was on meds bc at least she was getting some treatment but the OP said she was NOT on antibiotics and no bloodwork was done to check for infection. So they sent her home on no meds and with those stats.
