Real Estate Attorney - frustrated & questions
I feel very frustrated with our real estate attorney. He was recommended by our realtor. We have an accepted offer as of two weeks ago. We had the inspection done the NEXT DAY (two weeks ago) and retained the lawyer the same day. We still have NOT signed a contract. Is this a typical time frame? Am I over reacting?
Our realtor has apologized since it was his referal. The attorneys secretary is blaming the sellers attorney...saying they are slow.

Not sure where the hold up is but that seems a little long. Maybe the seller is holding things up. Maybe they are entertaining other offers? But your attorney should be fishing this out for you.

The seller's attorney is the one who prepares the contract, then sends it to your attorney for review. Then you sign, and then the seller signs. If the seller's attorney is dragging his feet and hasn't sent the contract over, then there's not much your attorney can do to get things into contract. But he should be communicating with you and trying to find out what the delay is on the seller's attorney's end.
So I would find out if your attorney has received a draft of the contract from the seller's attorney yet, and if not, why not? If the seller's attorney is holding things up, then maybe your agent can talk to the listing agent about what's going on. Sometimes a draft is sent, but then there's a dispute over a particular issue or provision, but if that was the case, I would think you'd know it!
But honestly, I find that most of my deals take 2-3 weeks from the time of the accepted offer to get into contract. By the time the inspection is done, the written report is received, the contract is negotiated by the attorneys, and the attorneys set up meetings with their clients to have them sign, it takes a couple of weeks.

im in the same situtaion. I keep following up with both my attorney and REA. Both have told me its the sellers attorney dragging thier feet on gettting a draft contract to my attorney. Its drving my DH crazy We are kind of nervous that they can still accept other offers.
