Our fence on one side belongs to our neighbors. The fence is falling apart and sections are currently being help up and together by twine. There are exposed rusty nails and gaps which isn't good when you have a 2 year old.
So, we are putting up a new fence and we are NOT asking them to split it. Easy.
Here's the thing, well 2 things: 1. It has been suggested by 2 fence companies so far that the neighbor's fence be removed as it is leaning (it's rotted)towards our side and will thus lean on the new fence and potentially interfere with installation. If you were the neighbor would you be upset/bothered that we were asking for this? And should we offer to pay for the removal? (estomated cost $75-$110)
2. We have a small piece of horizontal fence that meets their fence (ours is perpendicular to theirs) right where our house ends. We only need to put up fencing up to this point since this is aesthetically what makes sense for us. BUT, their fence actually continues by 6 additional feet and then their gate is there. If their fence comes down they would lose these 6 ft plus the post for their gate. Should we extend our new fence by these 6 ft strictly for them? And who pays for it - can we ask them to pay? (depending on who we use the cost of the extra section is $190-255).

When we put our fence up, our neighbor's existing fence was half down already. We approached him and told him we were getting a new PVC fence and that we would like to take what remained of his fence down. He was totally ok with it. We did not ask him to pay for anything nor did he offer. But DH and I took the fence down ourselves... actually, he came out to help up, but he was 82 years old so we tried to stop him.
I think you should incur the expense or labor to remove the fence, unless they offer otherwise. I do not think you should be obligated to extend the fence beyond you property, as it is they are benefiting from your new fence.

ITA i dont think you can ask them to pay to remove their fence, since clearly they have no problem with the damaged fence and if it was up to them, it seems they would leave it up. i would not offer to pay to extend the fence on their property. i would approach them and let then know you have no problem incurring the expense of the fence removal however that will leave them with a piece missing and then tell them if they would like the additional fence put up we are using xx company and they said it will cost theml $$
