Maternity Leave Question?
Can your company make you use your vacation time for maternity leave? I know I'm entitled to 12 weeks FML, but can my company make me use my vacation time with that?

mine does... and we're a law firm, so i would at least hope we're not doing something illegal!
we have to use up any "unused" vacation time after the 8 weeks of paid leave they give us, during the balance of the FMLA leave.
HOWEVER, 2 things -
first -technically they can't prevent you from using your vacation time earlier in the year whenver you want to
second - it's to your advantage (potentially) to use your vacation time because at least it's paid, whereas (at least in my firm) the final 3 weeks of ML would be unpaid. unless you don't need the paid leave of course (i personally can't afford unpaid leave at this point).

Thanks so much!
Do you know if I can use FML and a personal leave together? My company allows me to use 12 weeks of personal leave, but I'm not sure if I can combine FML and that?

i honestly don't know... maternity leave is so confusing (to me at least lol) and every company is different. I would ask your HR person, or someone who recently was on leave, etc.

I'm 10 weeks 3 days, so I'm going to tell my boss in the next few weeks and then I'll ask one of the girls about her leave.

I was told that we can only be out 12 weeks. this is everything combined... vacation/disability/FML... In other words I cant take 12 weeks FML and then two weeks vaca. It has to all add up to 12 weeks

We get either 6 or 8 weeks paid maternity, depending on the type of delivery (vaginal/c-section). We can then take any unused vacation before FMLA kicks in and we get the full 12 weeks of FMLA in additon to the paid maternity and vacation time so some women are out up to 6 months!

And here I was thinking it's not so great because I have heard of banks and other large institutions which automatically give 3 months plus vacation and FMLA.
