Can someone PLEASE explain
to me how NY Short term disability works?
- Do I need to apply for disability benefits as soon as I give birth or can I apply as soon as I leave work because of pregnancy?
- If I can apply as soon as I leave work and I leave work a week before I give birth, does that week count twoards the one week unpaid wait period?
- If I have to wait until I give birth to apply but I leave work one week before giving birth, does that week count towards the one week unpaid wait period?
- Are benefits for a total of 6 weeks inclusive of the 1 week unpaid week time or do you get paid benefits for 6 weeks AFTER the 1 week unpaid wait time.
- Can I apply for benefits After I give birth? If so, until how long after I have the baby can I apply? And would the ebenfits still be for 6 weeks? Im concerened say, If my company's maternity leave policy requires me to take all vacation leave for example befgore I can take unpaid leave does that mean that I would miss out on collectiing the disability? Or can you collect concurrently (Im pretty sure that the answer to whether you can collect concurrently is no). So if I had to take 4 weeks vacation, would I then be entitled to only 2 weeks disability? would I even be entitled to disability at that point since I didnt sign up right away?
My "HR office" is NO help. thank you girls!!!

I applied for STD at around 20 weeks...but worked till i gave birth so i used it for when the baby was born. I got 6 paid weeks, the first week was my own time, so technically it only pays for 5 weeks. If for whatever reaon you need stop working before you give birth, i believe your time starts then. so if you stop working 2 weeks before you give birth you technically only get 4 paid weeks after the baby is born.
could be different for different companies..not sure.

-I "applied" before giving birth and got pre-approval but all the real/final paperwork comes after the delivery

- I was told that it would only count as disability if a dr wrote me out. I couldnt just decide that I didnt want to work anymore. And yes, it would count as the one week wait period

- Again disablity doesnt start until day of delivery (or a dr putting you out).

-No, it is 6 weeks total. For me, I had to use 5 sick days as the first week so tech my job paid me the first week and NYS disability after that.

- Like I said earlier, I applied a few months before and got approved and they put in an tentive date (my due date). Then when I got out of the hospital I had to get the OB office to sign a few final documents and sent it out. I would do it as soon as you can after delivery but you definitly have to apply first thru your HR bc thats the bulk of the paperwork - so that you just have to have a dr sign one page and send it right in after delivery.

- if you are taking vacation leave I believe NYS disablity still pays?? Not positive on this one but my company has a STD policy where they pay me 66% of my salary and I got that and NYS disablity. But it could be different bc that is my companys STD benefit - I wasnt taking actual vacation time.
