Just a PSA: I got scammed.. can happen anywhere I guess.
Ok.. so I posted a happy anniversary to myself on 5/27 because it was one year since I bought my house. I had just spent $500 to repair our garage door too.
Well I lose those $500. *sigh*
My neighbor was having work done. I saw the truck and the employee. I ask if he can come look at our door (its REALLY bad) and he said yes. He finishes his job and rings our door bell. As I walk him over to see the garage my neighbors are outside leaving, say he did a great job and gave to big thumbs up. Off they go on their memorial day holiday.
Guy talks the talk, walks the walk. Shows us numbers, paint chips, shows us the company website, says because we have it on our computer, he’ll give us the $100 off coupon. Blah blah. Gotta write the check to him to go pick up the door and he’ll be back on Sunday to get it fixed. Oh you can call the company because we’re not allowed to give out personal phone numbers. Independent contractor, franchised company as per their own website.
With me so far? Sorry so long.
Well Sunday comes and goes, no guy. I call Sunday and Monday they will pass on a message – no guy. They don’t show me as a client. Tuesday he no longer works for the company. Owner calls me. My money was cashed at the local branch of my bank the day OF the check (the previous Friday).
I feel like such a loser. I should have KNOWN better!
Well I call the cops, I list both the company and the dude. Company owner says its not his fault, no matter how much the guy represented the company, I didn’t write the check to the company so he can’t help me. Well I don’t buy that and push harder. But nicely (believe it or not). He agrees to come by and look at my garage door and see what he can do.
This Sunday he comes by himself, in an unmarked truck with no uniform (not a great start if you ask me). I definitely need a new garage door. Like scary bad. He wants $340 PLUS tax to fix it. Average price here for door with labor is $750. I say no way Jose. The most I will be out of pocket and avoid a class action suit against him… .Because I’m one of 5 total families this guy scammed… is around $200. Otherwise, I have witnesses that show he was an employee on your time. You have record of his being here due to my neighbors. You have 4 others which make this a class action and yes, I *WILL* take you to small claims court before paying nearly $900 for my door.
He decided to back into the number I am willing to pay.
So my garage door will be $700 out of my pocket. I will never ever write a check to any independent contract ever again. Door should be fixed tomorrow.

I'm sorry you had to deal with that. I really hope that guy gets what's coming to him in one way or another!! What an awful thing to do to someone!!

yeah it bites. big time.. but I'm glad the company I could work it out.. cause I was seriously P.O'ed beyond belief.
Made a fool and lose money? SOMEONE was gonna pay!
Lesson learned for sure!

That's really horrible but I agree with the PP, I would just file a claim against him personally just so he has something on his record. That's disgusting! I'm glad it worked out for you though

I would never write a check to anyone until the work was done.

yes I was dumb. I beat myself SILLY over it. yes I wrote HIM a check not the company. I know, stupid stupid stupid.
As reply to the others, he skipped town/state. He had a GA license but he's not at this last residence. With 6 police reports on him, they are looking for him but he's gone with the wind.
$91 for small claims court here.
I was fully intending on taking the company to court, but they did come through and fixed my door for an extra $200 out of pocket from me. Considering the total cost should have/would have been around $750 (I called around). $700 out of pocket was a good deal to put an end to this mess and I have a garage door that's not broken now.

Can you put a stop payment on the check??? ETA: Contact your bank because he now has your account number on the check and routing number! Let them know you have been scammed and if need be provide them with a police report!

I don't think you're stupid. It was an innocent mistake. I was just asking because I was thinking that the guy really had some nerve! However, please don't write anyone checks to their personal name anymore. People really STINK!

Thanks.. did all that too. He cashed it out right at the bank the day I wrote the check. He got cash. They have it on file and I even paid the $30 stop check fee. *sigh* I wasn't fast enough to question it. He was smart enough to know I'd cancel the check.

Just a thought but can't you google him or do a Facebook search, try to track him down. He obviously gave you his real name and would have to provide ID at the bank. I'm so sorry this happened to you.

seems strange to me. the guy leaves the company over 500 bucks?
like pp said take him to court. seems very off to me.
oh just read that he skipped town? wow pretty crazy.
