Date Changed
My husband and I were supposed to close on the 23rd of this month and now the date has changed to 1st week or 2nd week of July, we don't even have an specific date yet, not to mention our lawyer is going on vacation the last two weeks of July and won't be back till July 26th.
We don't want to wait that long! any suggestions? anyone had a similar problem?

Why did the date change?
Apparently they were waiting for us to signed the commitment letter which their lawyer didn't advice them it was signed on MAY 20th!!!!
They are moving to Alabama and they were waiting on this letter to go out there and start looking for rentals! Plus the owner of the house is a school teacher and she said she needs to wait till the last day of school to put in her retirement papers!!!!
If she knew this, then why sign the contract for June 23rd???

Re: Date Changed
That sounds weird. Could you ask to close and let them stay for a bit after closing. This way they can clear what they need to and you won't have to wait till the later date to close. Just have your lawyer wirte up all the details .

Re: Date Changed
I believe in NY the contract date is an "on or before" date and they generally have 30 days +/- from the contract date.
Sorry I know it stinks. It happened to us on the last house purchase - they pushed it to the last day. We even lost our rate lock - we tried to get them to pay the penalities/fees to relock. I don't remember if they did or not. You really need to talk to your lawyer to see if I'm right on the 30 day rule to ensure it closes before he goes on vacation.
Good luck

I was actually being nice enough to make this offer but the seller is so stuborn he decline. He said to me yesterday "once I close I don't want to be in this house, I want to hand over the keys and leave I don't want to stay" smdh

Yes, you are totally right they legally have until July 23rd to close but our lawyer won't be in until the 26th, plus we might lose our rate too!
Our lawyer has already made them an offer for the first week of July to close, we are now just waiting to see what they have to say
