WWYD re Offer?
So after the going back and forth on the two houses, the first one, the one I loved location/splanch etc called us back..we had offered a strong offer last week but the house was literally on the market for like a day, we knew at the price the house would go quicklly...but the kids (kids are selling it for their mother) got greedy and figured that if they were getting an offer so quickly they want to hold out for a full price offer which I refused to give....The realtor just called us and said this to us, that they rethought it they love our family, and that the are willing to talk price to us now, but have a few requests...the mom (old lady that actually lives in the house) wants to move in October, which means we cannot lock in a mortgage rate yet...plus she wants to leave most of her junk in the house and we do the clean out etc....DH is saying that based on this he wants to lower his offer by a little bit...WWYD?? The realtor did say give us another price if you feel you want to after you heard the requests...

October isn't a big deal, since it would take 3 months on average to get a mortgage.
In regards to them leaving stuff. I'd like to know what stuff exactly?
You can place an add on craigslist "free stuff" and basically have the entire contents gone in a day or two. People will take anything.
Or put it all to the curb and people will take what they want and the garbage/special pickup will take the rest.

If the stuff is good, have an open house garage sale or by appt. and invite me :) then have Salvation Army come for the rest. If the furniture is in decent shape and you don't sell it, St. Vincents will come for it.
If it's the house you love, you may want to go for it. Think of long term.

I would go back with a counter offer, informed by their new "requests" IF you really want the house.
To be honest, based on your post the other day-- and this new info about the house, seems a bit of a hassle and the sellers may be a pain to deal with.
But, see how low you can get the house for-- the headache now may be worth it in the long run. Good luck!

It wouldn't for us, DH works for a bank, and we can basically get a mortgage pretty quickly, I'm not saying in super speed, but probably faster than the average buyer...his point is, we can't lock in a rate NOW, and would have to wait to lock it in without having to pay to keep extending it...
Randi, would you go back with a lower offer?? Thats what DH wants to do!
They aren't a hassle, it's an older lady and she's recently widowed and lost it a little, so we honestly do feel badly for her, and we're honestly in no rush to move..we still have our home, which we aren't selling so it's not a really big deal for us in the long run, but we can make it into a stink if you KWIM, to work for our benefit...I know has a piano that I would totally keep..everything else would be thrown away or donated.

If you love the house and getting the mortgage isn't an issue, then I would go back and counter offer based on the fact that you will need to clean everything out of the house yourselves at an extra expense.

I would make a lower offer and price out how much a dumpster would cost to get rid of the junk than can't be donated or sold.

I wouldn't think it would mess anything up. If you guys are willing to take on the task of clearing out the house yourselves. I don't know there would be too many other buyers interested in doing that without taking a reduction to the price kwim? I know personally, DH and I would walk away no matter how much we loved the house if the sellers didn't agree to a counter offer. But then again, we're lazy and want a move in ready home!

We would be in the same boat if the house was priced accordingly but since we want a shell of a house to gut and make our own, and since this price is a good amount off the other houses in the area we know it's a good price so we're workable...

If you absolutely love the house and are willing to wait until October to move in, but you want to lock in an interest rate now then see if you can buy the house and let her live in it after closing until an agreed upon date. We did this with our house b/c we were going to lose the lock on our interest rate due to the seller changing her mind on the closing date about 3 times. Granted, we did this for only 2 weeks, but you could do it for any amount of time. They pay a predetermined amount to cover the mortgage and taxes, plus they keep the utilities in their name until they move out.
You get them to put a certain amount of money in escrow (at least a few thousand) in case there are any issues with the walk through after they move out. You do two walk-throughs - one right before closing and another when they move out.

I think they won't go lower
they wanted a full price offer
basically they got that minus a fee to clean out the house (the difference in what you offered vs the asking price)
While I understand and agree with your DH, I tried to buy a house in almost the exact same situation and the kids got to be more of a PIA the longer we dragged everything out. Every one of them, wanted as much as they could possibly get out of the house, and at the end of the day, that's all they cared about.
You could, get an estimate on how much a company would cost to go in and do the clean out. base your neg. on that or if its not that much and your really love the house, just do it on your own.
I just know, these situations sometimes get messy because there are too many hands in the pot as they say

ITA with the too many hands in the pot..but they are now saying that they'll go lower bc of the requests...so let's see...we basically said to them, we gave you a number, now you come back to us with your number IF we agree to their requests...

I would see how much a place like http://www.1800gotjunk.com/ charges and lower your bid accordingly. Depending on how much stuff she has, it could be a total PITA to get rid of the stuff yourself. Especially with a toddler!

I would lower the price a bit. Since you are looking to gut the house getting rid of the stuff shouldn't be much of a problem.
I would also look into the pp suggestion of buying the house and then leasing it back to her for a specific period of time. While you renting to her you can start your renovation planning. Get contractors lined up etc. Oct will be here before you know it.

Except that it's a hassle and expensive -- labor intensive, plus hauling / carting.
I would definitely lower the offer by at least as much as it will cost to get rid of their stuff -- which could be quite a bit if you hire someone else to do it. I would base my offer on hiring pros to empty the house, not assuming I'd be doing the work myself.
ETA - I would also make very sure that your contract spells out exactly what can and cannot be left. I would make absolutely sure that they are required to dispose of any hazardous materials or materials requiring special handling (TVs, batteries, paint, etc.) themselves before closing.

I think you might have come to this conclusion, but yes-- I would go back lower, OR you can keep the current offer price, and negotiate some kind of credit to clean up after the current homeowner. This way they get the sale price they want, but you are not cleaning out at your own expense.
