Spinoff to paying for fence

My mother and I have actually talking about this lately, because they want to put in a new fence.

Their current fence was put up ten years ago, and they paid for the entire thing-it's a wood stockade fence. They put preservative on it every year, but when our neighbor behind us moved in three years ago, they wouldn't allow them to put it on the side of the fence that faces their property.

These neighbors also have two large (german shep./pit bull mastif mix) dogs that CONSTANTLY jump on the fence, and eat the bottom of it. My dad's repaired it multiple times from our side, but the entire fence is now at the point of replacing.

Obviously this neighbor is benefiting from use of the fence-she lets her dogs out in her yard for hours.

Do you think she should contribute at all when it's replaced?

I think when you have dogs you have to have a fence if you keep them in the yard? I may be wrong, but that is what I have heard.

If the neighbor's pets are destroying the fence, they should have to pay for repairs. They are not obligated to pay/contribute for a new fence. If they damage the new fence, then they should pay to have it fixed. If my dog damaged my neighbor's fence, I'd offer to have it repaired/pay to have it repaired.

Ditto.

Do your parents have any dogs? If not, take down the fence and leave it down. The neighbor will have to put up a fence then.

eta: so it will only be on one side, but then have your parents put up a fence on their other three sides...

Ditto.

we do have 3 dogs, but we walk them all the time anyway, despite having a big yard..when my mom told the neighbor that they would leave the fence down if they didn't contribute to the cost she was told they were being "un-neighborly"

the dogs the woman owns are annoying too-they've had multiple neighbors call the police because they bark for hours at a time, and don't stop

There is no fence between my neighbor and my house, they have a large dog that is always outside. I don't think it's a law....

I was told by the person that lives in the house behind us, that because I am putting up a fence (mostly to keep the kids out of our yard because they are ALWAYS in our yard), that I turned the neighborhood into an unfriendlly one....Chat Icon

Would they think about putting up a second fence. Leave the old fence up and install another one in front of that. It decreases the size of your yard a bit, but your fence will be nice.

ETA They can staple chicken wire to the old fence so the dog can't get to the new fence.

This is also a good idea, since technically the neighbor cannot take down the 1st fence since it is owned by your parents. Let them have the crappy one to look at.

Screw them, if the kids get hurt in your yard can you trust them to be friendly and not lawyer up?

I'd replace my crappy fence with one I liked & put up a chain link in front of the fence on their side.

I know someone who got tons of old used chain link fencing by looking on Craigslist.

That way you are still "claiming" your property & the dogs can't destroy the fence.
