rental nightmare
DH and I just moved into our new apartment 4 months ago. We used an agent to find the apartment and had to pay a months rent to her on top of the security deposit and first months rent. Well the apartment is horrible. We were promised by the agent that the nasty carpet would be cleaned and any gross areas on the walls would be repainted before we moved in. Well, the carpet was never cleaned (its not just normal wear and tear, its nasty) and it looked like someone went to the bathroom in the hand and then wiped it all over the walls, not just in the bathroom, everywhere. There is a leaking shower which has been reported but not fixed, now there is mold all over my bathroom ceiling and its a popcorn ceiling so not easily cleanable. All of this, we could overlook but the people who live downstairs play techno music all the time and its so loud the floors vibrate. We cant handle it anymore, we have tried everything to get it to stop and they wont. We want to move but the thought of having to put down another months rent without getting it back (making it around 3000 in only 4 months time) makes me sick to my stomach. I mean, what's the point of paying for the agent if it I'm still stuck in a horrible place. Is there anyway to get it back or have her look for another place for us without taking another fee?

ivate residence or complex? If complex you can call a main office. And, sidenote never use an agent. *I* personally feel they will stick you wherever just to collect a check. And as far as getting your $ back, fat chance. Im sure she will bang you again if you use her.

private residence... I know I know, everyone keeps saying don't go with the agent but we were looking for months and all the apartments that were at least halfway decent had an agent.

I had a problem with a neighbor and went back to the agent and she spoke with the owner. the agents reputation is on the line.
I would discuss it with the agent to see if they can get a solution before you move

do you have the carpet and paint in writing?
personally- I think your issues are with the landlord
there is only so much the agent can do- if the landlord isn't willing to fix things- the issue is with them
I had to use an agent to find my apartment this time- (building paid the fee) and I would call the landlord before I called the agent
