Never cosign for ANYONE!!!!!!!!!!!!!!!!
Well we went to the mortgage company to get a pre-qual letter and it turns out we found something on there that my husband co-signed a loan for and the original loan holder NEVER PAID IT!!!!!!!!!!!!! IT WENT 180 DAYS PAST DUE!!!!!!!!!!! The mortgage company said there is NO way we are getting a mortgage for this - Here's a few things though
1. We were never notified of the delinquency once. As a cosigner shouldnt he have been notified????
2. He said that supposively he refinanced it and my husbands name shouldnt have been on there.
3. Word of advice - NEVER COSIGN!!!!!!!!!!!!!
4. Question - Do any lawyers take care of anything being taken off of a credit report????? Is this even possible????

He would not have been able to take your DH's name off the loan without his consent, I believe. Also, I do think a lawyer could help you, but I am sure it will take some time.

1: I don't think they notify both parties regarding non-payment but I could be wrong. They usually go after the primary when it comes to sending things in writing. But I was never in that situation so I can't say for sure. They definitely will ding both credit reports if need be due to non-payment.
2: If its a morgage, he would have needed your husband's approval to refinance it (even if it was to take his name completely off) so I doubt he did this.
3: Agreed. NEVER NEVER NEVER co-sign anything. Not for friends. Not for family.
4: Will be difficult since the bank had the legal right to place the mark on his credit report.

My advice call the company which put the mark on his credit score and talk to them about it. Specifically say that you have had NO contact with the other person on the loan and they never contacted you in regards to being behind in payments. They will then call the person to verify if they had made contact with you regarding the bill. (If you are still in contact with them, tell them about the situation).
