Somethings not right here...need some advice.LONG...
Well, we closed two days ago and all went well except for the fact that we thought the actual closing costs were a bit higher that the good faith estimate (to the tune of $5K more). We ripped apart our closing cost summary and found discrepancies (it wasn't until after we closed since our attorney didn't even give us the final #'s until two hours before closing)
In looking at the #'s we found almost $2K in charges that we KNOW aren't right.. Needless to say I contacted our attorney. He did not return our calls yesterday, so we called today. Now he says that he'll speak to the title company (where the discrepancies are) and he'll have all charges reviewed. For example, we paid around $600 for a survey...isn't that a bit too high??
Bottom line....I think my attorney ripped me off. Did I mention he owns the title company (he never even mentioned that, we found out later on that day). If this even legal to do?
Can someone tell me just for example what they paid for the survey? You can FM me if you don't want #'s published.
I can't believe this isn't over yet!!

If they needed to re-do the survey... or get an entirely new one.... that may cost money.
You should ask him if he was able to use an existing survey. If he did... that should be cheap... less than $200.
What other costs were higher than expected?

Hi,
For some reason the old survery disappeared and we had to have a new one done to close.
It was $600 - -that was last summer

To let you know $600 is actually a very reasonable price for a survey. You are better off having a new survey even though paying for it does stink, it does protect you better as a client. And if there is a problem with your good faith estimate, I would take it up with your mortgage broker/bank. Chances are he is the one who left off the fees. Most mortgage brokers low ball the good faith estimates and don't know exact figures, especially when it comes to title fees, attorney fees, surveys, etc. You can never go buy a good faith estimate. It is just that, an "estimate". Oh, and no, it is not illegal for an attorney to own or have an interest in a title company/agency, but he should have been up front with you.

we paid $600 for our survey as well. There was one, but my attorney wanted to get a new one so there aren't any surprises, which I agreed with him and glad we did it.

The "good faith" estimate is a problem with your mortgage broker and not the attorney. I had the same problem when I closed on my condo 3 years ago and it was very expensive. It ended up being overcharges by the escrow company that was contracted by the seller. Unfortunately, there is little you can do other than small claims court and even then they probably could provide information that they are "in-line" with current costs. This is what an attorney told me at the time.
I don't know if this applies to your situation, but I just wanted you to know this happens ALL THE TIME!

Our survey was about $600 also, so he may not have been ripping you off. I agree with the post that said the problem is with your mortgage broker. We had to go back and forth with ours a couple of times before closing to get the right figure.

Didn't your attorney go through all the paperwork as you were signing? the totals, explanations of what they were for and how they got those totals?
