Re: Should I give the$$ back?

I'm assuming there is no lease or agreement signed...

I would give the money back if you don't plan on holding it vacant for her.

ETA: I thought about it more and I'd send her half back - because you have one month before her lease was to start to look for a new renter. You were inconvenienced for about a month.

If you haven't cashed the check yet, do so and let it clear before you send anything to her!

I agree with the OP. If you don't plan on holding it for her, send the check back. If you do plan on holding it for her, keep it.

But by me holding her deposit, I did not show the apartment. I could have rented it out for April and May so now I lost $3100.00 for those 2 months.

I would keep it. She has nerve asking you to continue to hold it for her. You are losing time and money.

Re: Should I give the$$ back?

Without a signed agreement, I would give her the money back. I understand you are out the money you would have gotten if you had not held it, but stuff happens.

If you have a signed contract with her, then legally, you may be able to keep the money.

Re: Should I give the$$ back?

I would learn my lesson and move on.

I would send her the money back and explain to her that you were doing her a favor to hold an appartment for 2 month for $500 which is less that what you could have rented it for. That you cannot keep holding the appartment with the same $500 for A FEW MONTHS. You feel you have extended the favor to a reasonable amount of time to take the appartment and losing a few months in addition is not feasable at this time.

Side note: she is completely out of her mind. Who is their right mind would not rent an appartment and ask a landlord to hold it for several months with $500 and think it's OK?

Re: Should I give the$$ back?

i would keep it...i saw something like this on people's court...there wasn't a signed lease but they backed out at the last minute so the landlord was able to keep the deposit to make up for the lost rent.
