NEED HELP FROM SOME H.R.PEOPLE
A friend of mine just called to say that she was fired. An e-mail went around Friday saying no personal calls. Her mom called to ask about her son whose not feeling well. After she gets off the phone, her boss asks her if that was a personal call, she said yes. Her boss said she could leave. Can a company fire you if the call is regarding there child. SHe works for a small insurance in the area.
Any help will be greatly appreciated

i really dont think they can fire you for personal calls i mean if it was a emergency and her mom need to call her than he has No right to fire her I would fight it!

unfortunatly yes, a job can inforce whatever RULES is deems fit to the envirnoment and that can be one of them because she was informed before hand. My job makes you advise your supervisor before you are expecting a personal call so they are aware.
She should be able to get unemployment though. I doubt they would fight it in this situation.

It su cks big time, but the bottom line is she was told as were others is was not allowed.
my honest opinion would be WHY would she want to go back and work where she gets fired over a phone call about her sick child?

NY is an employment at will state. A company or an employee can end the employment relationship at any time with or without notice.
There is no rule that says employees must be allowed access to the telephone.
The only law that NY has regarding a "sick child" is that if an employee is entitled to paid sick days, they can use a paid sick day to care for a child who is sick.

I agree with suvenR and dm24angel 100%. Unfortunately, what the company did was totally legal, is it ethical is a different question. Again, I am sure she can get unemployment.

I'm in HR - I think there must have been something more going on behind the scenes. Does it say in their handbook that personal calls are grounds for termination? Her boss may have been building a case against her and that was not the only thing happening.....
