we have a used car that we sold to someone in mid-january via e-bay motors. He came to the house, liked the car, gave us $400 of the $3,400 agreed upon price. At the time he said he'd come back at the end of the next week with the balance to pick the car up. Nice guy, wanted it for his daughters, etc. One other thing, we also gave him a spare set of 4 tires to go with the car because we had them. He took them that day. Two weeks went by and we called him. He finally called us back on 2/8 and we were both at work so couldn't call back until later that day and since then have received his voicemail and sometimes his vm is full. DH left him a message saying to please call us back, as far as he was concerned the car was his and wanted to work it out. Now, for me, I just want to get it out of my driveway because it is causing a hassle. Plus I'm paying the insurance on it too. Based on the fact that he gave us a deposit, and we did give him tires that day, do we have a right to withdraw and try and sell it to someone else? If we never can get in touch with this guy what the heck do we do? I mean, I'll even take the $400 in exhange for the stupid tires because I was sick of looking at those too. I guess I'm looking for advice both from a legal perspective and otherwise. Thanks.

I don't know anything about this from the legal perspective ...
And these probably a stupid suggestions, but since you sold it through eBay ...
1) Have you tried contacting him through the website?
2) Have you tried reporting the transaction to TPTB at eBay?
