Re: Anyone in HR?

I want to thank all the ladies who FM'ed me!
I have limited time online- so I will just ask here-
Is it normal for a first ever written warning to state that the next instance will lead to termination?
I am sure that they can do whatever they want- I just want to know if it is a bit harsh or not.

Re: Anyone in HR?

Hi there
I am in HR
It does seem hardsh to me but like you said every company/firm has their own policies and procedures.
Sounds like this copany has one written warning and termination
Good luck and if you have any other questions please let me know.

I on the fringe of HR here.

For my company, we tend to have several verbal warnings before it becomes an official written warning. So by the time some one is written up, it usually is their last chance.

Re: Anyone in HR?

It's hard to determine whether or not this is harsh without knowing the circumstances surrounding the warning. In general, a company should be able to have a policy like this as long as the policy is being applied equally to everyone.

I agree. In a "perfect world" that would be ideal, but I've experienced the opposite unfortunately. Most jobs do as they please when they want to get rid of someone. That's why it's best to leave and find something else before they come up with a reason to fire you. Final warnings are basically like you hanging on a loose thread that is ready to break.

Where there verbals warnings prior?

We follow a progressive dicsciplin approach. Verbal warnings, write-up and then if no improvement termination.

Re: Anyone in HR?

I was in HR for years with 2 companies i worked at. They both had 1 verbal warning, i think the next was a written, and after that termination. Or it was 1 verbal 2 written and then termination. So yes that does seem a litle harsh to me

Re: Anyone in HR?

Thanks ladies! The written warning refers to verbal "warnings", but none of those conversations were labeled a "verbal warning" at the time- they were conversations. This is the stupidest thing ever to write someone up about- and the policy is not consistent. The company is looking to fire me, but I think since I am pregnant, they fear recourse. I just fear losing a job while pregant, bc no one will hire me right now.
I definitely know they are just looking to fire me- there are tons of signs, and vague talks about how they can't afford their staff, and how fat will need to be trimmed. I am under a microscope, and this written warning is just rediculous. Not to mention incorrect in it's statements. I will list my disagreements before signing, but it just makes me so nervous. Will a well documented termination like this lead to my inability to collect unemployment insurance?

You can still collect unemployment if you're terminated as long as you weren't terminated for willful misconduct (i.e. stealing; purposely violating company rules). Your employer would have to prove that you engaged in this in order for your claim for benefits to be denied.

If you think they're trying to get rid of you, document everything and protect yourself. Your company must be consistent in applying its policies. If your employer treats you differently, you could sue them for discrimination.

I completely agree. Also make sure your documentation is on your HOME computer. Your work email is company property.

The normal course of action is verbal (it doesn't have to be highlighted as this is a verbal warning, it can be a conversation), written, dismissal. However unless you're covered under a contract, it is employment at will. They don't even need to warn you. They can termiate you at any time.

Re: Anyone in HR?

I work in management and one write up then a termination is very harsh. I noramally do a verbal then a written and it takes 3 writtens before I can fire someone.
Good Luck!
