Co op board issue

I rent a co op where most people own and when i signed the lease with the landlord he said i could have a dog. Now the co op board sent me papers saying that I can not have a dog. :( Everyone in this complex has a dog some have 2! I am so upset Chat Icon

I am sorry to hear that. They should have been more clear when you signed the lease. I own a co-op unit and although owners are allowed to have dogs, sub-lets are not. It seems to be common.

Does your lease say that you can have a dog? If so, then I would show that to the board along with the paperwork for the dog.

ETA: Apparently if you have had the dog for 30 days - there's nothing they can do about it.

there should be a grandfather clause. If you have signed the papers and it longer than 30 days u should be grandfathered in and no new people can have dogs

awe.. good luck!! We're in a co-op also, but it's very pet friendly! Definitely check out your contract and all the papers from the co-op regarding pets. Please keep us posted!

I live in a co-op that I own and they tried to evict me for "harboring a dog". There is a clause that states if you have had the dog open and notiriously for over 90 days by law they can not make you get rid of the dog. So if you have walked the dog and other people (neighbors, maintenance, security) can attest that they have seen you have the dog for over 90 days there is nothing legally they can do to evict you.

Depending on your coop board they will try though...although this law was in effect when they tried to evict me I still had to hire a lawyer, they held my maintenance checks for almost a year and then the finally dropped the case. FM me if you need more info.

i would throw a royal s*it fit if my co-op board pulled that with me. when i bought my co-op we signed papers saying that you were allowed one dog, up to 30 pounds. a few people have a larger dog than that or 2 dogs... but they were "grandfathered" in because they lived in the complex before those rules went into effect. i would reread all your paperwork, because if they told you you were allowed a dog when you purchased/leased, there is no way no how they can just make you get rid of it.

Unfortunately even though your landlord has given your permission to have a dog, the bylaws and house rules of the Cooperative as a whole trump any paperwork that you have signed... (I'm a property manager of Coops)

If you have had the dog for 90 days and they have known about it and have not tried to get you to get rid of it, then you would be able to keep the dog...otherwise, unless you could show that the dog is relied on (emotionally, physically, etc....by a Doctor's note or testimony) you'll probably have to get rid of the dog.
