any divorce lawyers out there?
Let me start by saying this is not for me, it's for my BIL. So BIL and his wife has decided to get a divorce. They've been married just over 2 years and own an apartment in NYC. They have to be legally separated for a year in order to get divorced. So here's the situation... Initially BIL was just going to walk away and leave her the apt, which is what she wanted. He was going to move back home for a few months to save money and move on with his life. He was under the impression, as told to him by his wife, that she wanted to stay in the apt. and her dad was going to cover her mortgage. Now I'm not sure what happened to change that, but yesterday she tells him that she wants to seel the apt. and he needs to continue paying the mortgage until they do. She said they could each stay at the apt. for 2 weeks each month, which is the most ridiculous thing I've ever heard of. So now if he continues paying the full mortgage, shouldn't he be the one to get to stay there until it's sold? Shold he only be paying half of the mortgage? He's not really sure what he's supposed to do now. If he has to pay the mortgage he will not be able to save any money. Even when they sell, they're going to have to pay back her dad and I don't think they're going to make any kind of profit.

That's the one! I'm sorry to see any marriage end, but I love the fact that I never have to see that b!tch ever again!

She sounded pretty horrible from Day 1.
Did something in particular happen to cause the divorce?

Did something in particular happen to cause the divorce?
Apparently they've been in bad shape since about Easter. They started seriously talking divorce in June. BIL wanted to work on things and see a marriage counselor, she didn't. She is away alot for both business and pleasure and was away for 3 weeks in August. The last 2 she was away they didn't speak at all. When she came home she left him a note saying she was going away and was filing papers when she got back.

Don't they have their own lawyers who are handling this?
You won't get any legal advice here. It's against the ethical code for lawyers to be dolling out advice on the internet -- or to anyone who isn't a client.
Besides that, I don't do domestic relations law at all...
They each need to find a competent attorney to represent them.

Thank you. I didn't realize that initially. As far as attorneys go, I'm pretty sure she has one, but he doesn't. He didn't think it was going to get to that point. He really believed if he just gave her what she wanted and walked away, then things would go very smoothly. I think he's realizing now that he's going to have to get a lawyer to protect himself.

He DEFINITELY needs to get a lawyer - as soon as possible! From the little I do know about divorce and family law, it can be a complex and complicated process. It's in his best interests to have someone working on his side, with only his interests at heart -- also someone who isn't emotionally invested in the situation, who can give him solid advice. I had an adjunct professor in law school who is a divorce attorney and I am blanking on her name. She is apparently very well respected. If I remember her name, I will FM it to you.
