okay... venting over for now.
Taking this down before someone sees it who shouldn't.
Thanks for the advice and support! I will update when we have a solution!

Re: dear stupid *** real estate agent
Nothing because she won't call me back. I will continue to keep calling her.
She's got us between a rock and a hard place and there's nothing we can do about it. We knew this COULD happen when we signed the contract. We weren't naive about that. We just didn't think she'd be so twisted as to lie about what her client really wanted in such a material way. So we locked early and now we are getting screwed. I just want to know what about her client's circumstances changed so drastically that now she is causing us a delay in closing.
Last time I trust someone's word when it comes to my money. Consider this a lesson learned the hard way.
I get that she represents the seller. I get that under the contract they can do this. What I don't get is why they didn't have the decency to tell us this earlier, when there was still something we could have worked out with the mortgage lender, etc. Now it's too late.

Re: dear stupid *** real estate agent
Sorry you have to deal with a RE agent like that. Sometimes I feel like this entire home buying process is so shady.
Good luck from here on out!!

Re: dear stupid *** real estate agent
I know not all REs are like this. I happen to know a bunch of really nice, honest ones! I just can't believe I have to deal with THIS one.
I know she's not on our side - but I'd think she'd at least be remotely honest. Or even close to honest.

Kara, how come your contract gives all the rights to the seller? Aren't there provisions for the buyer?

Re: dear stupid *** real estate agent
Kara - you should contact your lawyer and have them contact the sellers lawyer. You might be able to close earlier and allow the seller to stay in the house in order to keep your rate without paying. My friend did this last November - her rate ended on November 15, so they closed on the 15th but the seller stayed in the house until 30th. Good luck, I'm sorry you are dealing with this.

Re: dear stupid *** real estate agent
Sorry Kara, and I hope the advice here helps you. I don't have much else to say besides that.
We were rushed by our lawyer and our mortgage broker to sign contracts - causing me to leave work early twice and spend all this time right before the holiday weekend. They overnighted them to the seller's attorney even.
And then find out that the seller won't have time to sign for a week afterwards. Tell me again, why I rushed?
Anyway, there's nothing worse than knowing someone wronged you and there is nothing you can do about it. Hopefully, this will become a distant memory soon enough once you are in your new home.

It doesn't give all the rights to the seller. Conversely, I actually think it favors us in many ways. Our lawyer made many changes, all of which they accepted. However, legally no one HAS to close until 30 days from the date in the contract -- that can't be changed. We technically can't force them to close earlier.
To those who are suggesting I talk to my lawyer, already have. She's the one who informed me that the seller can't move until later. We are trying all of your suggestions and basically seeing what sticks.
Ugh. I just want to get in that house and start ripping it apart already. It needs so much work!

Re: venting over
Hang in there! The sellers told us 2 days before closing that they couldnt' be bothered to close on said date and our lease on our apartment was almost up and my sister-in-law (I live in a 2 family), well her due date was coming up very quickly (and of course, there were the concerns about losing our mortgage rate, etc, etc.) It's soooo frustrating that there's really not much you can do and that you're at the mercy of the sellers. To compound things, even though we could have crashed at several family members homes in the meantime, I work from home and really need my office available to me. It's one thing to crash in the spare bedroom, another to move an entire office in! We were really, really upset about the whole thing
When we finally did close (and we were super annoying to all involved regarding closing asap - sometimes people will get a move on just to get you off their backs!), the sellers saw my sister-in-law and said "wow, you really left it to the last minute, didn't you?" I thought her head would explode! (She had a beautiful baby boy 5 DAYS after we moved in.) Now we've been here for 5 months and we're really happy to be in our home. Although, whenever we even have to think about the sellers, our collective blood pressure goes up! Just hang in there! Take deep breaths. Try and distract yourself. Good luck!
