What does being an executor to a will entail?
Thanks.

it means that you carry out (execute) the wishes of the deceased

Re: What does being an executor to a will entail?
Would there be any reason for the family members to give the executor a hard time? No right, since they don't have any control over what the person put in their will.
Someone in my family asked DH to do it and I don't want him to get caught up in drama if the person's sibs are annoyed by any of it.

Re: What does being an executor to a will entail?
Honestly, it can get dicey for an executor. My DH's uncle passed away a couple of years ago and named his cousin as executor. It took forever to settle the estate because some folks named in the will weren't happy with some of the provisions in the will.
DH's cousin (the executor) said it was such a pain because he ended up getting grief from those unhappy family members. It eventually all got settled, but it definitely took its toll.

you never think that there will be a problem. If the will is written correctly, you shouldn't have a problem. If you tell your relatives ahead what your will says then that should be that.
My parents have a provision in the will that states if anybody fights over it then they don't get anything.
I'm the executrix of my parents will.
also, my parents don't have much but there are few heirlooms that some could fight over.

I am the executor for my dad... I can't see how you can refuse a request like that though.

It's weird, it's my relative, we're not really close to that side of the family, this person and their sibs aren't close either. The person said if he doens't want to, no big deal, but they really trust DH and know he'd make sure their wishes were carried out. He's leaning toward doing it, but we were just trying to anticipate if it would become a problem since one of the person's sibs is very argumentative and is going to be pizzed that they weren't named executor.
Gotta love family.....

It can be complicated and time consuming to be the executor of a will. It's hard to really tell what the situation will be postmortem and since a will is a public document, everyone can request to see it and contest it. Perhaps a irrevocable trust may be a better alternative then a will.

It's better not to be named executor if you're getting something under the will... Can get messy if people start to fight over things. It's best to have someone not getting much under the will (or anything at all) to be the exeutor.

I totally agree with this. My family gets along really well with one another, but when my grandmother passed away, a couple of people made some noise about money. My mom shut them down right away. When it comes to money, seemingly normal people lose their minds.
I also totally agree with a "no contest" clause. My MIL recently did her will (with DH as an executor) and there have already been rumblings about how she has decided to do things. But she put in a no contest clause to try and spare my DH some grief after she passes away.

Re: What does being an executor to a will entail?
I would only accept being the executrix of my parent's will. I don't think the ensuing hassle and legal woes are worth it for anyone else.
At least with my parents, they have me as a no-nonesense person who won't try to "get my share". I think it's disgusting to expect to profit from someone's death. You get what THEY deemed appropriate and that's the end of it.
Sadly, many people see dollar signs when someone passes. I have a friend who has been in a 5-year legal battle over his father's will because his brother "assumed ownership" of things that weren't his.

Re: What does being an executor to a will entail?
My friend is going through this right now. First of all, she has to front all the bills from the estate. She will get the money back when the estate is all sold and settled, but as a young professional, she doesn't have it to front her own bills and bills from the estate. However, when all is said and done, she does receive about 5% of the estate, which will be helpful to her.
