I am so stressed out..
I am so stressed out at work I just want to cry. My desk is COVERED in work and while I do not mind that--it keeps me busy and I am working hard to get a promotion something happened today and it just sucks.
I work events for a University..Hours are 830 to 430 and I get paid hourly.. I work almost every event which means aLOT of overtime.. This was great b/c my pay is so low that the extra money gets me buy..pays my bills..and helps me not needing a 2nd job b/c there r no extra hrs in my day!!
Well today I was told that as of now I can not get PAID overtime but I can tally my hrs from here on out and get COMP time--b/c there is no room in the budget for extra money..
I am so upset. This is the ONLY reason I dont mind ALL the extra Hrs. I dont NEED MORE VACATION TIME (comp days)
I NEED MONEY!! COMP TIME DOES NOT PAY MY BILLS..
I am so upset  I need a new job
PLUS I am so sick STILL from vacation and that is just adding to my frustration.
Thanks for letting me complain

ummmmm.... I'm pretty sure that's illegal........By law they have to pay you overtime for anything over 40 hours..

From the NYS DOL:
: What are the regulations regarding overtime?
A: Covered employees who work overtime must be paid at a rate that is one and one-half times their regular, "straight-time" hourly rate of pay.
For non-residential employees, this overtime rate applies to all time over 40 hours in a payroll week.
For residential employees ("live-in" workers), this overtime rate applies to all time over 44 hours in a payroll week.
The overtime requirement is based on hours worked in a given payroll week. Thus, time and one-half, double-time -- or any amount higher than the agreed rate -- is not required simply because the work is performed after eight hours per day or on a Saturday or Sunday.
Some categories of employees are excluded from New York State's overtime provisions. These state exemptions from the requirement for overtime pay are identical to the federal overtime exemptions outlined in the Fair Labor Standards Act (FLSA), listed by the U.S. Department of Labor, Wage and Hour Division at:

I wouldn't refuse but I would speak to your HR dept and say "It was my understanding when I tool this job that it would include overtime which I am fine with, however, since I have been here since (date), I have come to include that in my compensation. I checked on the NYS DOL website and if I am interpreting it correctly, I am entitled to time and a half if I work past 40 hrs/ week".

Hopefully you find out about the promotion soon. Otherwise look around to see if you can switch departments. My mom works for a university and she said there are constantly jobs opening up.

I would not talk to HR. I also work in a university and we have different classes of employees--exempt and non-exempt. Exempt employees basically work as much as it takes to get the job done (and are higher-level than non-exempt), and here we get comp time, though I don't think they are required to give it to us. It's not like a company, and they are not required to give you overtime.
I feel the same way--I get comp time because at my busy times I'll be here til 9 or 10 at night...But it's a catch 22 because I am always too busy to take vacation days. I took 1 day off all summer.
If you want a regular 9-5, I'd look for a different job.

Check the details to make sure you are even covered by the provision quoted. MANY jobs are exempt or don't qualify for those specific guidelines.

You get paid hourly, not salaried?
I would think that means they have to pay you for exactly the number of hours worked (with time and a half over 40 hrs? Not sure if that applies to employees who are paid hourly.).

I am a salaried exempt university employee. We have the same comp time crap if we need to work ot. We do get paid if we have to be on call though. I would definately try and find another position in the University. The budget sucks for us this year too.

And, if they try to tell you that your job has always been exempt, you have your pay stubs to prove you've been receiving OT all along.

Before someone goes complaining to HR, I'd find out how it works for all other exempt and non-exempt within that particular organization. It sounds like they are changing her from a non-exempt to an exempt, in which case it would go from hourly to yearly rate. If she is exempt, they certainly are not required to pay overtime.
