I fired my Landscapers...AGAIN!!!
my landscapers never showed up last week for our weekly service. So after placing 3 calls to them to find out if they were intended on showing up on Saturday...DH left a message on Sunday to not come back, just send us a bill for services rendered.
The last time they showed up was Thursday, May 24th. We placed the 1st call to them on Saturday June 2nd...asking where they were.
Fast Forward to today, June 7th (2 wks since they last were here)...the guy has the nerve to call me and tell me that we signed a contract for weekly service for the season, and if we want to canel we are responsible to pay for the season. I informed the stupid jerk, that he breeched the contract 1st. Weekly maintance means that sometime between Sunday through Saturday of every week, you show up to perform the agreed upon service. They failed to do that, and failed to return the 1st 3 calls asking where they were; and therefore I have a right to consider the contract null and void. He threatened to take me to small claims court. I actually laughed...I told him that I would love to meet the Judge who would award him $$ for services that were never provided.
He claimed that he tried calling DH's cell phone lon Sunday but his call went unreturned. I informed jerk off that I was with DH all day Sunday and his Cell Phone never rang...and I can prove it with the itemized bill.
What a jerk...this idiot is lucky he got me on the phone and not DH.

What an arse! Glad you told him to take you to court. The judge should have a good laugh at his claim.
We're in the process of firing ours. I had a guy come look at our lawn for an estimate yesterday. Hopefully he's reasonable so I can ax the guy that doesn't understand what a weed is.

I would so take him to court. He failed to provide you with services. My DH NEVER has people sign contracts for lawn maintenance

you sound like me - only my landscaper fired ME when I called to complain (nicely) about the no-show and the fact that he gave us an estimate in writing for one service, then doubled it on our invoice.
What I will say is this...and let me preface by saying that I do NOT agree, nor find this acceptable. My dad is a contracter (exterminator) and he tells me that the mentality of contracters, no matter what industry, is that they don't care. They have lots of work to do so if you're unhappy and fire them, it doesn't make a bit of difference to them. He says that if you're not sugary-sweet to them, they'll sometimes F you over. (PS - my father is not like this, so if anyone needs a good exterminator, FM me.)

I have to agree with this. A few years back we decided to have Scott's Lawn Service take care of out lawn. I was billed for a service that didn't take place and when I called to inquire, I was SCREAMED at by the woman who answered the phone. She then put the technician on the phone who, supposedly, serviced my lawn and he told me to "get on my hands and knees and look for the fertilizer that was put down". Needless to say, the conversation got very ugly after that and I stopped their service. They still, to this day, send me advertisements to use their service. Like that will ever happen.
