Need ebay help
I purchased a telephone headset off ebay and it doesn't work, nowhere in the auction did it say that the item was sold as is, also I was charged 9.99 for shipping and it cost the seller 4.36, the receipt is on the box.
I contacted the seller to inform him the product didn't work and he pretty much said too bad the item is sold as is
Do I have any recourse?

As far as the shipping, they can charge what they want. You are also paying for packaging, etc.
If it doesn't work and the listing doesn't say it is used, you can file a complaint with ebay and try to get your money back that way. If you paid with Paypal, you can also file a complaint with them. I think Paypal is faster as far as getting your money back.
Hopefully, you didn't leave feedback yet and you can threaten the seller with negative feedback.
