I am so ANNOYED!!
So we were going to move into guest room of house this weekend, since we got it all painted and set. We are still working on master bedroom, and need to have floors replaced, so can't move into it yet.
Needless to say we got delayed because we noticed freaking termites!!
I did have the termite inspection, but the wall they were in was covered up with shelving, and a bunch of crap leaning on the wall.
What pisses me off though, is the old owners KNEW of the problem. The company I called to come take a look said they had in their computer system that the owners scheduled a treatment, but then cancelled!
Is there anything I can do? Or is it totally our problem at this point?
Grrr! Thanks for letting me vent!

Re: I am so ANNOYED!!
first I would def. call your termite inspector. I don't care if shelves were in the way, you paid him to check it out and its not the previous homeowners fault if your inspector didn't find any. I would seriously go that route first. You may get your money back. Especially if you know that termites were present during the inspection (based on the other companies computer records).

If they knew they had termites and deliberately withheld this information, you have recourse. If you can, get it in writing from the company they used that they had an existing termite problem, when they had a treatment scheduled for and when they cancelled. Then, contact them and let them know that they need to rectify this problem. If they refuse, you can take legal action through small claims court. If you don't want to contact them yourself (or if you don't know where they are), let your lawyer do it. Either way, they are legally obligated to fix the problem.

You definitely have a case against the old owners since they cancelled their termite treatment. You may even have a case against your inspector for missing that!
My friend is involved in a termite case right now, her house has extensive damage in many rooms and the old owners knew about it and the inspector should've caught it!
Good luck, I hope they are just in that one place!

I don't know if she has recourse if the sellers paid the disclosure fee? Call the termite co. 1st then call your atty.
