"Gift"

We saw a house today that had a hot tub in the back. The realtor said that the owner was leaving it as a gift to the buyers.

I have also seen things like this in Levittown, where sheds were being left as gifts.

For some reason, this sent up a red flag. It didn't seem on the up and up, if that makes sense.

Can anyone tell me what the deal is with sellers leaving "gifts" for the buyers?

It means they don't have a CO for the item. If there is any problem with the title they may have to remove the item. We had this with the pool in the backyard. There was no CO and they had to get one for the den that they had built, so when the town came to inspect they had to take the pool down to get the CO. In our case it didn't matter, because we didn't want the pool so they saved us the trouble of taking it down.

It's a long-shot, but if we do decide to put in an offer on this house, and we end up getting it, what do we do then? Does the seller need to take it down? Who has the responsibility for getting the CO's for this? (we would want to keep the hot tub)

If the title is okay, you may not need to do anything. Its usually only if there is a question in the title that you have to worry about the CO. No matter what, it's the sellers responsibility. Just be aware that they may have to remove the hot tub. They'll probably leave the hookups and hardware and you could just put it back in when you close.
