Giving Notice at job question
I got an offer for a teaching job for September and am giving my 2 weeks notice probably today so I have time to prepare etc.
I have a feeling though that they might tell me to leave immediately.
If that happens, can I collect unemployment? I am nervous about not having any income for the next month until my first paycheck.

Giving Notice at job question
If they tell you to leave immediately, I believe they still have to pay you the two weeks notice. I would talk to HR.

There is no HR department. TINY company with 5 employees. There is a part timer who does payroll.
I'm a nervous wreck but HAVE to tell them today if I want to give the full 2 weeks.

They don't have to pay you anything if they ask you to leave. At will employment.
Collect unemployment for two weeks.

They do not have to pay you. NY is an employment at will. They can tell you to leave anytime you want. It is pretty standard with companies I work with that you give notice and they walk you out the door.

Nothing says you HAVE to give two weeks notice. It's a courtesy, that's all. If you're worried about burning bridges, then yes, but if you're worried about losing two weeks of pay, then you don't have to give them notice.

If you give 2 weeks notice and they tell you to leave that day or even a day before your 2 weeks.
You ARE entitled to unemployment.
If they tell you to leave and pay you until the day of your 2 weeks then no your not entitled.
I am in HR and just had a case like this that I fought in 2 rounds of hearings

Just went through the two weeks notice period. At my job, they want you to give 4 weeks, I did at first. They told me oh you can leave in two weeks, like after ten years, they just wanted to cash me out and leave.

Thank you.... they have been interviewing and I have a feeling they are going to hire someone before my 2 weeks are up and are going to tell me to leave. I gave notice because I need to be paid until that date.

I wouldn't sweat it too much. I don't know what you do, but its difficult to hire qualified people. Even if they are interviewing during your 2 weeks, the person they hire will need to give some form of notice as well. Then on top of that if they could actually overlap with you, generally management looks at it as a training opportunity.

If you file for unemployment because you quit, they can deny you unemployment if you did not quit for a good reason. Also, there's a 1-week waiting period. So really, it's not worth it over $425, which is all you would get in the end.
