Car accident ? UPDATE on bottom
OK, my mom was parked and got hit by someone while picking up her grandchildren from school. Everyone is fine, but there is 400$ worth of damage. The girl said she would pay for it and suggested a body shop to get the work done. They exchanged numbers and names. No police report.
They were in contact by text. By text she agreed to pay for the damage and she also told the body shop she would pay.
She texts my mom today and says that her bankruptcy lawyer advised her not to pay. My mom called the lawyer and he was like listen she will give you 100. My mom says no. She mentioned calling the police so they can go through insurance. The lawyer said your rates will go up. It's typical lawyer talk.
My question: can she file a police report after the fact? She doesn't have the plate number, but she has name and cell phone and cell phone provider.
What can be done? My mom really doesn't want to go through her own insurance because she doesn't want to pay the deductible and she was parked.

She can file a report (at least in NY). And I would call he insurance company and file. They will subrogate against her insurance company. If she is a good driver and doesn't have any claims her rates should not go up. Tell her not to deal with the girl anymore. Did she get the girls insurance info?

Yes to all of this.
I got in an accident, it was MY fault and my rates still did not go up.
So her rates shouldn't go up, that lawyer is just a douchee.
And I'd be so pissed at this point that I'd do everything in my power to screw this bitchh over

i am not sure about filing a police report, but if you go through insurance and it is the girls fault, she will not have to pay her deductible.

OK, so she called the police and they are on their way to file a report. They said it doesn't matter if she doesn't have a plate number.; they can look her up and get insurance info. I'm wondering if she even has insurance at this point.
And yes, my mom is pretty annoyed and she is just doing everything to get her car fixed. I think the other driver is just ignoring my mom now. Oh well, too bad!

I always hear of problems when it is decided to keep the insurance out of it and the person at fault will pay. The other person always gets screwed.

I know! When my mom told me this a few days ago, I first asked if she got a police report. She said no and that the girl was working with her. My mom has never had an accident. She has only gotten hit in parking lots by people who don't leave a note. Unfortunately, I've had my share of accidents (mostly not my fault!)
I don't understand why people don't go through insurance. That's what they are there for. Is there ever a reason not to go through insurance?

I think people are under the misconception that their rates will increase even if the accident is not your fault. Also, if the damage is minimal it might be more hassle free to deal with it without involving insurance.
But I never will again. I hit someone's car door with my door while getting into my car. It left a pretty obvious scratch and the woman was pissed. I told her to get an estimate. It was a small scratch, I figured it would be $100 or less. She wanted $350 so I called my ins co who never paid out for some reason. I think it ended up that I just left paint on the door and didn't really cause any damage. I learned my lesson. I will always go directly to my insurance company.

What a jerk! Her bankruptcy lawyer - geez.
Sometimes people won't go through insurance if the damage is less than the dedutible - why pay $500 or $1000 if it's a $200 fix, KWIM? But in all other cases, always go through insurance!

I'm glad your mom is OK.
FTR: We had a car that was damaged badly by a drunk driver while it was parked. Although we had to shell out the copay upfront we were reimbursed at the end from the drivers insurance.
I hope your mom files a report and goes after that girl..what an ass she is.

File a third party claim against her insurance. If you don't know her insurance file the police report to get it. Hopefully she has the plate number.

Honestly I don't think there's much you can do with a name and a cell phone number. The police would have to hunt her down and even if they found her, it's her word against your mom's.

Your moms rates won't go up unless she hit someone.
Call the police file the report. Does she have the girls info who hit her? Car, insurance, license plate etc?

The police went to the house and didn't issue a police report. She had 5 days (today is the last day) to do that. What they said was to meet her where they had the accident. If she didn't show up, the police would issue a summons for leaving the scene of an accident. The police told my mom to get in touch with her.
So my mom called her and she was not happy. She didn't understand because she didn't leave the scene of an accident. She then kept saying she couldn't meet her at the scene of an accident and she couldn't pay for the damage and how she has no money, etc.
She also doesn't understand why she would have to pay as she was working and they should pay for her accident. She's a nanny (she quit or got fired from that job yesterday? Anyone lose a nanny yesterday?) using her own car. No, that's not how this works.  She said she would call her insurance and tell them my mom hit her!
So they were going back and forth and she became a bit more reasonable. She would call the auto body. The auto body said call your insurance (State Farm). She did and my mom has talked to her (the other party, not her own) insurance company and that she would get a rental car, etc.
So that's that! Thanks for all your help! By man, some people!

Well, I'm not sure if she got fired, but she said she quit. My mom has come to the conclusion that she was possibly fired (for asking for more money to pay for her accident). I mean when they got out and talked at the scene, she was saying she shouldn't have to pay and that her employer should pay. Then she offered to pay for the damages. Who does that if you are filing for bankruptcy?
I don't think any kids were in the car. It happened when my mom was parked waiting for the kids and reading her Kindle.

Ugh some people are seriously ridiculous! My mom got hit from behind at a light recently and had a similar issue. She was able to file the police report and track the person down but what a headache!

I'm so glad your mom is going through the insurance! You just never know with people and with this case, the girl was giving her the runaround. Glad it is resolved!

I'm glad it worked out.
A good lesson for the rest of us. Take down the license plate as quickly as possible & take photos of your car, their car & damages with your cell phone.
