Prosecutors Charge 6 Baltimore Officers in Freddie Gray Death

BALTIMORE — Prosecutors here, in an unexpected announcement, said Friday they had probable cause to file homicide, manslaughter and misconduct charges against police officers in the death of Freddie Gray, who died after sustaining a spinal cord injury while in police custody.

In a news conference, the state’s attorney in Baltimore, Marilyn J. Mosby, described repeated mistreatment of Mr. Gray. Time and again, she said, officers abused him, arresting him without grounds and violating police procedure by putting him in handcuffs and leg restraints in the van without putting a seatbelt on him.

Ms. Mosby also said the officers had repeatedly failed to seek medical attention for Mr. Gray after he was injured. By the time he was removed from the van, she said, “Mr. Gray was no longer breathing at all.”

“We have probable cause to file criminal charges,” Ms. Mosby said.

As she announced the charges at the War Memorial here, there was cheering from people in the crowd. Dozens of police officers dressed in riot gear stood nearby after days of unrest in the city.

Ms. Mosby said six officers were being charged, one with second-degree murder. She said warrants had been issued for the their arrests; she said she did not know if anyone was in custody.

One officer, Caesar R. Goodson Jr. was charged with second-degree murder, manslaughter, assault and misconduct in office. Lt. Brian W. Rice was charged with manslaughter, assault, misconduct in office and false imprisonment. Officer William G. Porter and Sgt. Alicia D. White were each charged with manslaughter, assault and misconduct in office. Officers Edward M. Nero and Garrett E. Miller were charged with assault, misconduct in office and false imprisonment.

The fact that they made an additional stop and did not report it is damning. The fact that you could see he could not walk when they arrested him; and they had to know they were carrying his entire weight coupled with the fact he was asking for medical help is horrible. It says there is so much gross negligence and they need to be charged with his death/murder. One of the officers has already had his mental stability questioned since 2012.

The fact that you could see he could not walk when they arrested him; and they had to know they were carrying his entire weight coupled with the fact he was asking for medical help is horrible. Not walking getting put into the van I don't think means much because plenty of people being arrested , who resist, go limp to make it harder. BUT I do believe the fact that he was not belted, and who knows how the van was stopped and going, looks like made him fly around back there hitting his head hard enough on the back of the van (bolt mark in head showing he hit it) may have been what snapped the chord and caused his fatal injury. And the fact that they didn't belt him or get him help after "checking on him" is negligent on their part and should be charged bc of that.

I still don't believe it's solely race related. It's criminal related and negligence on behalf of the officers involved.

And also, I have to ask why? Why did he run when he saw the cop? not blaming him for the death or what the cops didn't do - I just can't understand what causes someone to run if they have nothing to run about.

Good.

There were 3 stops after Gray was put in the van - one time to put leg irons on him, another to "deal with him" and another to pick up another prisoner. The stop to "deal with him" is under investigation - if they did nothing wrong, why haven't they been cleared instead of having warrants issued?

And at the very least - his death may have been caused by injuries sustained in the van and that he was unrestrained in the police van which is against police protocol.

One of the arresting officers, Brian Rice, had documented mental health issues and allegedly made threats and had his guns confiscated.

Freddie Gray cannot die in vain. Systemic oppression and police brutality cannot be tolerated. We are only scratching the surface of what is really at play.

There is evidence of a fourth unreported stop. I would like to know what happened there. They did not report it. They went inside and could have belted him in, but did not do so in violation of protocol. His heads were behind his back so if they went normal speed he could have gotten hurt and not been able to brace himself.

I know that some people go limp during arrest, but he looked hurt vs going limp.

If you read what I wrote , I am not blaming him for his own death or for the lack of care on behalf of the officers. I truly wholeheartedly do not understand why people run. It never ends well. Even if it ends in just an arrest.

because police are trained to chase suspects. This guy had nothing on him and the arrest was illegal, but running to a trained officer provides a presumption of guilt, or else why run. Just answer the questions and provide Id like they ask.

If this is in fact the reason, maybe part of the conversations they are now stating they will have, there should be the understanding on how police officers are trained. This way all involved in every police vs civilian interaction can start out on the right foot. That's at least the hope

For this- the whole department should be brought up on charges of negligence. This man shouldn't have been working. Once there is suspected mental health issues that cause your weapons to be taken away- I think a desk job is warranted for the rest of your working life.

Yet why do people keep getting abused by the police to the point that even though members of the community are in the police force these horrible types of incidents keep happening?

I don't appreciate the antagonism.

Though we may be outnumbered, there are people who feel very differently about this issue. People who do not see it through a priveliged lens. I am not here to argue with people. But I believe that the prosecutors are making the right call.

Baltimore has been in a slow-rolling crisis for decades. This is not new. No one should pretend it's new. Baltimore has paid out approximately $5.7m in 4 years to settle police brutality cases. Those figures are facts, and they don't get pulled out of thin air.

Historically, Baltimore has been reeling from deflated industry and economic decline since the '60s. Of course, this causes increases in crime AND poverty. In the '70s, which a lot of people don't know, is that the police department began illegally spying on specifically targeted communities. It was called the Inspectional Services Division and they primarily focused on African Americans. The ISD spied on community activists, politicians, black owned businesses, students, pretty much anyone they considered a person of interest, not just criminal activity. They created files against people who had never been arrested or even involved with illegal activity! They were simply doing this "in case" they needed info on someone or needed to try to prove something. The ISD felt that the attack on black civil liberties was a small price to pay for so-called "law and order." Again, this is fact - there is a 1975 report from the Maryland State Senate that confirms its existence.

So when a community feels - and IS - unfairly targeted, fear, crime and poverty creates an atomosphere ripe for abuse. I read a quote that stood out to me:
"The Baltimore Police Department is a far more just and able institution today than it was in the era of the ISD. The officers work to police a cash-strapped city with deeply entrenched woes. Many officers, I have no doubt, are courageous and good. But they are part of an institution that has long viewed Baltimore’s African American community as something to be feared, contained, and tamed. It is little wonder, with such a stained history, that frustration at times leads to violence."
