Sofia Vergara and exfiance fight over embryos
Sofía Vergara’s former fiancé, Nick Loeb, has filed a lawsuit in California to prevent her from destroying two cryopreserved female embryos created through in vitro fertilization, 'In Touch Weekly' is reporting exclusively.
Court documents obtained exclusively by 'In Touch' reveal that just six months before their split, in November 2013, Nick and Sofía had embryos created as a result of his sperm and her eggs being fertilized.
Nick, who filed the suit under the pseudonym John Doe, “seeks to ensure that the Female Embryos are not destroyed, but Jane Doe [Sofía] refuses to agree to their preservation under all circumstances,” the document obtained by 'In Touch' states. (The lawsuit was originally filed in August 2014; it was amended with new information and refiled on April 1 after Nick sought new representation.)
The court papers also claim the 42-year-old actress “was physically and mentally abusive” to Nick on numerous occasions. “She punched him in the face on two occasions, kicked him, and threw her phone at his head. She also routinely bullied him, calling him a ‘loser,’ ‘worthless’ and other degrading names,” according to the papers.

The court documents also state “John seeks to save from destruction two cryopreserved Female Embryos created using John’s sperm and Jane’s ova for the purposes of attempting to have children. However, before the Female Embryos could be implanted in a surrogate, the Parties ended their relationship,” adding that Sofía “hoped for the Female Embryos to ultimately be destroyed” but “John does not desire for the Female Embryos to be destroyed.”
The documents claim that when Nick and Sofía met at the California-based fertility center on Nov. 16, 2013 — four months after their engagement and prior to undergoing a second round of IVF — they got into a heated argument about what should happen to the new embryos in the event of their death. (The center provided forms to the couple for a decision about what would happen in the event of death — but not separation, Nick claims in the document. Because of this, he is also suing the center to prevent them from destroying the embryos.)

He wants to keep them because she has money. Why else would you want a child with a woman your no longer with? And allegedly abused you. Go find yourself another woman and have kids with thr woman you marry.
I agree with sofia in this case. I wouldnt want him to take those embryo, find a surrogate and now my child is walking around whom i made a decision i no longer want.
Hes pro life when his pockets will get fatter.

His story sounds like a load of you-know-what. If I were her I'd want those embryos destroyed too. He's after her money in this little scheme.

Not if they split though....only what would happen if one of them died

I thought he did sign:

Not sure if the circumstances are true for why he signed but it sounds like he did it.

Yes, they were. It's mandatory. But stupidly whoever did them only discussed what would happen if one of them dies, not split up which is crazy

Not sure if the circumstances are true for why he signed but it sounds like he did it.
He agreed to it if one of them died, but supposedly not a first. And then she got abusive in the offce and he's trying to say it was signed under duress, trying to nullify it

I hate to say it but those embryos are half his as well and he has as much right to them as she does. My RE office NEVER EVER took the time to sit and go over such paperwork. They throw it at me last minute when in a rush and no time to read, think about or ask questions. Who knows what was discussed but again they are half his.

This is what I would think too, but allegedly he only signed papers that stated what should happen to them if he died. I have done IVF through two different clinics and both had me sign documents stating what to do in divorce, separation, death, etc. I'd be pissed at the IVF clinic if I was her!

The clinic is at fault too. I mean yes they should have read them but they went over every scenario with us and what would happen to our frosties

I have no idea, just a thought about why he is adamant. They are rightfully hers if she signed the papers and she is acting as such. The embryos are a result of her choice and her ex BF (if they are theoretically not her egg) but are legally hers as well as his. Similar thing happened with Sherri Sheppard, no?

maybe because she hates him enough for her not to want him to have them. If someone else carries those embryos that child will be part of her as well and they will forever be connected
and if she was 42?? at the time of IVF and freeze I will say those embryos might not even make the thaw

They are Sofia's eggs.
As for Sherri Shepard. Totally diff. Wasn't her eggs used. Plus they had already implanted the embryo into a surrogate and she was already pregnant when they got divorced. She wanted nothing to do with the baby bc it wasn't her eggs, she didn't carry the baby and then she would be responsible for child support to her ex.

Sherri Sheppard used a donor egg and it was implanted in surrogate. While the surrogate was pregnant Sherri broke up with her husband and wanted nothing to do with the baby.
Not sure what has happened now. The surrogate was caring for the baby after he was born.

I did ivf and whatever we signed was in the event of death of both of us. And it was thrown at us too. I didn't know what to pick and felt confused and randomly picked an option.
I know A LOT of people are saying he's in it for the money and I don't know him, so what do I know? but I wonder if maybe he is emotionally invested. I felt I became a mother before I was pregnant Bc I was trying SO hard to get pregnant. And the fact they know they're female leads me to believe they were tested for specific traits. They're half his too. Maybe he really wants them and is religious and feels destroying them is wrong? Maybe he feels this is his shot at being a father. Maybe he doesn't even want child support from her or for her to be acknowledged as their mother?

based on what I read they are hers unless im reading it wrong.
if they were her eggs at her age, in her 40's they might not even survive the thaw
