update on AJ school thing (bully)

Backstory for those not aware:
Girl bullies AJ in aftercare twice reported
Girl grabs AJ's crotch and hurts her in recess
Tons of other incidents not reported of this girl bullying my daughter

I want this girl out of my daughter's class
To me, this is NOT the first, the others in aftercare count as district policy states ANY TIME as long as its on property.

We've spoken to:
Principal
Vice Principal
Counselor
Nurse
Teacher
Aftercare providers

Recently:
reported to the District Police who say under 10 there's nothing they can do.

Ok......................
Firstly.. on Sunday (yesterday) we had a girl scout meeting where half the girls go to school with AJ and the moms wanted to know why I'd been so distracted (I'm the leader now) and I mentioned what was going on but not her name. One mom pitched in (before I said what she'd done to AJ) that a little girl told her daughter "I will kill you AND your family" which I mean really WOW! I can't compare to that. But she asked me to finish what this girl had done and I did. Grabbing crotch etc. Then she said very clearly to me "Who was it? Tell me her name." Since AJ and her daughter play together and have recess together I felt obligated to I said XXX and she said "Yep that's the girl who wants to kill us"

Today. I asked that mom if I could use her statement. She thought and said "No need the school knows it was aftercare who told us not our daughter" I said "NOPE that's how this mess started with AJ, call the school get it documented"

I decided to call the superintendent who's office asked if I had spoken to the executive director of my daughter's school. Who knew they had such a thing? A level above the principal that is.

So before he calls me back the principal does. She spoke with the father then both parents this morning. They do not want to remove the girl. I am not happy. She STILL says this is not bullying and I argue again all the reasons it is. PLUS I added the mom's statement from above. I explained I have gone to the next level, she agrees and will talk to him.

He calls me just now before they talk. I go through this whole rigmarole again.. cause I'm nearly fed up explaining it! He is the first one who actually AGREED with me. I don't know if I believe it or not. But he had a few comments but mostly just agreed with my interpretation of their procedures. He was shocked that the aftercare hadn't informed the school. I AGAIN compared AJ to seeking her out to a woman wearing a skirt in public. That the first is no more seeking abuse nor does it justify the bullying anymore than the second invites rape or the justification of that! I added that this is repeated abuse and what's next a call to say AJ has been shoved off the top of the slide by this little girl and seriously injured? He asked "Do you know if this little girl is special needs?" I said I didn't think so but that's not my profession. He really thinks it may be that.

So we shall see, eh?

I'm exhausted but staying with it.

I made it clear I'm not letting this go. Even if its summer time or next year I'll stay on this and talk to whoever will listen. "Your district was strict enough to allow a threat to shut you down, then the VERY NEXT week you ignored your own rules and a boy brought in 3 guns to school, how much else do we need proof of procedures not followed when it starts at a low level like bullying with 1st graders involving sexual contact?" I included "I thought I moved out of South San to get away from negative press" which is my old 'hood, known for violence and gangs. They are constantly on the news. My current district generally doesn't make the 5 o'clock round up but I'm very willing to change that.
