The child's mother was also in the vehicle. I tend to put more blame on her for not ensuring the safety of her child. Whether or not she new the license issues of the driver I can't say, but she should have ensured that her child was restrained properly.
Also, the article on Newsday stated that the seat was belted in but that the child wasn't properly restrained in the seat.
IMO, they should both be charged.
My first thought was maybe the toddler unbuckled his seat, grandma or mom was reaching back to help and lost control of the car. But since the 4 year old wasn't in a carseat or booster, sadly I'm not sure that was case. Neglectful
The child was 15 months old, not 4.

Yes, but if you read above, a summons was issued regarding not having a 4 year old in a proper restraint.

Skipwith was issued summonses for two misdemeanors -- second-degree aggravated unlicensed driving and suspended registration, police said. She was also given summonses for two violations -- having an uninsured car and not having child restraints for a child under 4 years old, police said.

Ahh, so then it appears the child was not in a carseat then. Otherwise why should be given a summons for that? I thought they were talking about a sibling.

Re: so sad...saw a car accident today..
Maybe she was just in a booster seat (whatever you call it) as opposed to a regular car seat. Since she was in her Grandmother's car instead of her usual vehicle of transportation, maybe they just figured it was ok? Totally stupid! It's not an excuse, just trying to imagine what the he ll were they thinking?!!!!!!

Yeah maybe. The child was ejected from the car though, so I'm thinking there was no carseat or booster seat at all.

How would they know that though if the child was ejected? I can't imagine the mother admitting the child wasn't strapped in?

It's so sad and this story breaks my heart!

Re: so sad...saw a car accident today..
The poor baby that died was only 15 months old so def no booster seat there... looks like the grandmother was summoned in the past for possibly another grandchild who was 4 yrs old... Whatever the case was, it ended horribly and both are responsible for that poor child... grandmother should not have been driving and mother should have properly restrained her infant/toddler... there's no excuse!

Re: so sad...saw a car accident today..
That is awful I am CONSTANTLY on my mom about strapping my kids into their seats...she says I do it "too tight" and she tries to leave a good 4-5" clearance when you pull the belts taut. I told her, sorry, but these are MY babies and I'd rather it be too tight than too loose. I always check the belts before she goes.

Re: so sad...saw a car accident today..
I see it all the time...parents driving around with their kids just bouncing around the back seat, parents with their kids in the front seat with no booster seats....its just awful and it makes me so mad
IMO there is NO excuse, none at all.
I dont care whose car you are in..if your kids are in harms way then you should not have them in that car. PERIOD.

Re: so sad...saw a car accident today..
I don't want to Monday morning quarterback on this. All we know is that it is reported that there was a restraint in the car, installed. We know they have not said she was UNrestrained only that misuse occurred.
We have no idea what type of restraint was used, only that it wasn't used properly. You can be cited for not using a restraint if you're not using it right I believe (a police officer would have to confirm, but officers I've worked with/know state they will ticket for severe misuse).
Leaving slack in a harness can lead to ejection.
Only buckling the chest clip can lead to ejection.
Not putting the arms in the harness and only doing the lap portion can lead to ejection.
Just having a seat isn't good enough. Installing it isn't good enough. Using it improperly can be just as detrimental as not using one at all.

It must be a genearational thing. My Dad gets so aggreavated when we are struggling to get DD in the seat. He is like- it's too tight, this is ridiculous, there has to be a better way, etc I am like NO- it's NOT too tight- her safety is more important than her comfort and NO there is NOT a better way. Jesus! He really aggrevates me.
Yes, back when we were kids we didn't have this, yes, we were fine. Yes, putting her in a rear facing carseat in the middle of my sporty car's back seat is a HUGE HUGE PIA. But I really dont' care. This is for her safety!
Advancements in safety happen for a REASON!
It drives me nuts.

I agree. I know my mom's carseat is not properly in. I know absolutely nothing about carseats but it just doesnt seem right to me. She claims my brother put it in (he's the dad) so it must be right. She's very blase about it. Nothing my brother does is right so I dont know where she's getting this from. I've emailed her contact info for the safety and she's tried calling but hit a few roadblocks. I recently begged her to bring it to the next event on 12/17 in Plainview. She said she will (and she won't have my niece in the car until then). Many prayers for that family!
