Obese Third Grader Taken From Mom, Placed in Foster Care
Were the authorities justified in their actions?

A Cleveland third grader who weighed more than 200 pounds was taken from his mother after officials reportedly said she did not do enough to help the boy, who suffered from a weight-related health issue, to lose weight.
“They are trying to make it seem like I am unfit, like I don’t love my child,” the boy’s mother, who was not identified, told the Cleveland Plain Dealer. “It’s a lifestyle change and they are trying to make it seem like I am not embracing that. It is very hard, but I am trying.”
Officials first became aware of the boy’s weight after his mother took him to the hospital last year while he was having breathing problems, the newspaper reported. The child was diagnosed with sleep apnea and began to be monitored by social workers while he was enrolled in a program called “Healthy Kids, Healthy Weight” at the Rainbow Babies & Children’s Hospital.
The boy lost a few pounds, but recently began to gain some back, the Cleveland Plain Dealer reported. At that point, the Department of Children and Family Services asked a juvenile court for custody of the boy, citing his soaring weight as a form of medical neglect, according to the newspaper.
Taking obese children from their families has become a topic of intense debate over the past year after one high-profile pediatric obesity expert made controversial comments in the Journal of the American Medical Association advocating the practice in acute cases.
“In severe instances of childhood obesity, removal from the home may be justifiable, from a legal standpoint, because of imminent health risks and the parents’ chronic failure to address medical problems,” Dr. David Ludwig co-wrote with Lindsey Murtagh, a lawyer and researcher at Harvard’s School of Public Health.
A trial is set for the boy’s ninth birthday next month to determine whether his mother will regain custody.
But one family who has been in the same position as the Ohio family told ABC News they disagreed with the practice when “Good Morning America” spoke with them in January.
“Literally, it was two months of hell. It seemed like the longest two months of my life,” mother Adela Martinez said.
Her daughter, 3-year-old Anamarie Regino, weighing 90 pounds, was taken from her parents and placed into foster care a decade ago.
Anamarie didn’t improve at all in foster care, and she was returned to her parents. The young girl was later diagnosed with a genetic predisposition.
“They say it’s for the well-being of the child, but it did more damage than any money or therapy could ever to do to fix it,” Martinez said.
Anamarie Regino, who is now a teenager, agreed.
“It’s not right, what [Dr. Ludwig] is doing, because to get better you need to be with your family, instead of being surrounded by doctors,” she said.
When told of the Regino case, Ludwig said his solution of state intervention did not always work.
“Well, state intervention is no guarantee of a good outcome, but to do nothing is also not an answer,” he said.

I don't know it's a very touchy subject. I did see on dr Phil something like this ad the child lost a lot of weight when he was taken from his mom and given to his dad. I don't know if foster care is the right option though. The kid could withdraw because it's traumatic and turn to food anyway...

I don't know that foster care was the answer, but I am glad that officials are monitoring the situation.
If they have the child going to an excercise program regularly, along with doctor appointments & nutritionists, I don't think it was necessary.
If they were skipping appointments, then I'd say it was warranted.

So, instead of requiring the mother and child to go to classes, get diagnoses, and improve the family's eating and exercise habits, they decided that ripping a child from their mother, putting them in a very stressful environment, and having a proven track record of not always working is a better answer? Don't most people eat more when in a stressful situation?
I don't see how this can be a helpful situation....

I think this is horrible. A family like that needs nutritionists, psychologists, etc. Very slippery slope IMO

I think maybe offering educational seminars to the parents would be a better solution.
I'm willing to bet these parents have weight problems themselves and just don't know how to fix things.
It seems easy- but there are so many cultures who show love through food. Maybe they fall into one of those categories.
Taking the child from his home isn't the answer.

I don't know if foster care is the answer but something needs to be done about this issue. Kids learn their eating habits from their parents, their parents are the ones buying the food, monitoring their exercise, etc. The kid only knows what he or she is taught and told to do. I know a few parents who let their kid choose their dinner (usually fast food) because they don't like what the parent is making. That is unreal to me. They say "oh I wish I could get my kid to eat healthy" you make them. We had to growing up. Kids don't know better and would eat McDonalds and ice cream all day if you let them. Also, I'm not a chef. I take into consideration what the kid likes out of healthy food but won't be making a bunch of different meals for each kid...that's expensive and time consuming and I'm not a chef. I also know a lot of kids who sit in front of the tv all day everyday. I don't think that's acceptable either.

Sorry, I think ripping a YOUNG child from their parents and putting them in FOSTER care is disgusting. Proper food education for both child and mother is what should have been done. The mental stress this puts on a kid in the longrun is awful they should be ashamed of themselves.

That's just it, the mother was going through a program to help get her son to a healthy weight. It started to work but then the kid started gaining more weight. I might be in the minority but outside of a medical issue that makes a kid heavy no matter what, having a child that big is child abuse. Having said that I don't know if foster home is the best place for this kid.

I don't know what to make of this. To be honest, I don't know exactly how many steps they took before removing the child from the mother. Maybe it's been going on for years and the mother just can't/won't change. They also didn't exactly say if it's a medical condition or if the child is obese due to lack of exercise and poor diet. To me, it's terrifying the shape that kids are in these days. I'm no picture of health, but I can't imagine any reason, aside from a medical condition, why a healthy nine year old should weigh 200 pounds.
ETA: To give you a little perspective, this kid weighs only slightly less than my 6'8" husband!

ITA! I think children should only be taken from their parents in extreme cases of abuse/neglect! This is a very slippery slope! What's next?? Taking children with recurring ear infections away, bc clearly their parents are doing something wrong if they keep getting sick?! (I don't really think this, but it seems like a similar argument!)

I agree. My daughter is the same age and weighs 55 pounds, I couldn't even IMAGINE what a 200 pound 3rd grader looks like. I do think it is abusive to allow an obese child to continue on the same path they are on and overeat themselves to death. The mother has ALL the control in this situation, she decides what food comes into the house and can limit what he can eat.

She did have him in the program though, so it wasn't complete neglect. We don't know why it didn't continue to work. It could have been medical complications, an ineffective program, emtotional issues that weren't addresses, or no follow through at home.
I find it interesting that she took him to the Dr for breathing problems, but not for weight gain. She is obviously concerned about his health, but did she really not see his weight gain as a problem prior to teh breathing problems? She must have taken him to a pediatrician at some point--I am surprised nothing was said/done earlier.

I don't know if foster care is the right answer, I think I would have preferred an in-patient type of setting, but I am not even sure if that exists.
Hard to tell from the article, but mom says she was trying, but it was "hard". What was hard?? Obviously education and an out-patient type program were not working if a year later he was still gaining weight.
There are medical conditions that will cause a child to gain weight uncontrollably (i.e. ROHHAD), but other than that - mom should have the control here. A 3rd grader is not buying and preparing their own food. Where is his school in all this? He is eating at least 1 meal a day there, no?
