our attorney is MIA - venting...

I am soooooooooo frustrated...please bear with me...

Our attorney sent contract revisions to the seller's attorney on Friday, April 8. We have been waiting ever since for a revised contract...we heard from our attorney once - this Tuesday April 19. He said he spoke with the sellers attorney and everything is good and that we'd have the revised contract to sign that day or Wednesday...

We found out yesterday that our attorney has actually had the revised contract in his possession since last Thursday, April 14. All he has to do is see if the changes were made and send it to us for our signatures. But he hasn't done so!!

We reached out to him yesterday (calls and e-mails), our agent tried to reach him as well and so did our mortgage broker - AND HE IS NOT REPLYING AT ALL TO ANYONE!!!

What do we do?! What could possibly be going on here??

I am soooooooo mad. I am tempted to call the office (again) and say - is he alive??

Am I overreacting? What could possibly be taking so long? Why can't he just shoot an e mail and be like, I am swamped and I'll get to you guys as soon as I can.

Thanks so much for listening - if you have any advice, I would greatly appreciate it!

I think the holidays may have thrown a wrench into your transaction.

I would call again though but that's just me. Chat Icon

I don't know if he's Jewish...

When DH called the office this morning at 9am, the receptionist asked who was calling, he said his name and was put on hold...and then she came back and said our attorney was with a client...

We haven't received a call back yet...nor an e mail...nothing.

The revisions needed were just clarifications on the exclusions and the closing date...nothing else...

The sellers need to move fast and feel they can be frustrated with us at this point...

Can we switch attorneys? I feel like having the selling attorney send me the contract and I'll find a different attorney at this point.

What stinks is that this attorney came through a family reccommendation...

Blech...

I can't stand attornies who take forever to return calls. I feel your pain.

I don't really care about the holidays either, becuase if this attorney was not working for the holiday he should be letting his clients know this prior.

Go there in person. I had to do that with one particular attorney a few years ago.

I hear you - I cannot stand when people in general do not reply to calls or e mails...it takes two seconds to say I'm sorry, I am busy...

I can't get by there today but I am off from work tomorrow and I will definitely plan a trip to the office if we do not hear anything today...

Still nothing...12:13...

DH doesn't seem as frustrated with this situation. But, I am tired of everyone seeming so passive with this whole home buying process!!

A ton of money is on the line here and people need to shape up or ship out.

I refuse to lose this house because of a slacker attorney!

the fact that the receptionist said he was with a client leads me to believe he's not out for the holiday or she would have just told you that...I would call and demand to speak to someone regarding this issue and make a stink!

I want to do exactly that - demand the contract and make a stink but...DH does not want me go that route...

It's so hard...gotta compromise with DH but at the same time, I gotta do what I feel is right...

1:04 and still nothing - I am taking a walk on my lunch break and keeping my fingers crossed for a reply when I get back...

Re: our attorney is MIA - venting...

This is the stressful part. I kept calling our broker and our Attorney until i got mine signed and then until i got the signed copy from the sellers attorney.
These people do this for a living and should realize the deal is not done until the Contract is signed by both seller and buyer. Just because it is not there home does not mean they can slack. Our seller wanted a quick sale but it was her attorney that held everything up. Chat Icon Chat Icon Chat Icon Chat Icon

Keep calling and if you can go in and demand to speak with them. It only takes 2 minutes to sign the Contract once you go into the office.

Good luck and i hope you have it soon.

I don't think it's a big deal. Considering the rep of real estate attorneys, I think he's doing good!

He got the revised contracts last Thursday. He called you on Tuesday to say everything was good. It's now Thursday. I don't think it's a long turn around time at all, especially taking into account what his calendar may have looked like. He may have had closings yesterday or court appearances or whatever. Maybe he should be communicating with you better but sometimes you just caught up in other more urgent matters. He'll call.

I would expect a call by 4:30 this afternoon from either the attorney or the assistant. If not have they other attorney call him.

If I could, I'd show up in person if he doesn't respond to the numerous phone calls and voice mails. I really hate my colleagues who think client's concerns are not as important as theirs! Theres no reason for him to sit on this for more than 1 week! Lots of Chat Icon Chat Icon

honestly... and i hate to say this... i'm not surprised you haven't heard from him yet. i've heard (and witnessed) much worse from RE attys (including some former colleagues) in terms of response time and sitting on things. sorry you're dealing with this. Chat Icon
