Can I fight a red light ticket?

Or there's no shot?

eta: it was a camera ticket.

Is it a camera one? I fought one and won because they put up a sign clarifying that you have to stop after I got the ticket. Other then that, I don't think you can.

If it's not a camera, you can.

My DH is a cop and gets called to court all the time for people fighting red light tickets he wrote.

Here is a bit of insider info that most people don't know.

When a cop gets called to testify on a ticket he wrote- for anything really- he has to give a certain testimony. Certain things need to be said. It's almost like a script. For example he needs to say something like: "I observed the vehicle 10 feet before the marked intersection, and watched said vechile going through a steady red light, etc etc." He has to state that he witnessed that the light was working prior to pulling you over, he has to say he observed it change from green to yellow to red- a whole laundry list of things.
Pretty much if he messes up one part of that testimony, you win.

It's not at all how you would expect it to be- not a he said, she said thing.
The judge listens for certain points to be hit in the cops testimony.
If the cop is experience at testifying he will probably do everything right.
But regarldess, it's worth a shot.

If its a camera it might be hard. I got a red light ticket and after watching myself on the video- you can clearly see I went through the light.

I think you have a better chance of beating it in Suffolk than Nassau.

I'm not fighting the ticket itself-I clearly ran the light. I'm fighting that I never received the first summons and so they tacked on a $25 surcharge so my $50 ticket just turned into $75. I called and spoke to someone and she told me the address it was mailed to.

Summons #1- mailed to physical address where we do not receive mail. This hasn't been my mailing address in over a year. It's changed with the USPS and DMV. Even if it was mailed here and received, I would have gotten the letter either way.

Summons #2- mailed to my mailing address. Received this one.

My mailing address has been on file with DMV and USPS so there's no reason it should have been mailed to the first address in the first place.

Anyway- the woman I spoke to said I have to file an appeal for the $25 fee. Yes it's only $25 but it's the point. Like I said, I ran the light-I have no problem paying the $50.

It's stupid I know. Just annoying.
Wonder what would happen if I just mailed the $50?

I think the extra $25 would be fightable but, it's probably best to do it in person as opposed to just mailing the $50 in.

From my understanding if you take the time and show your face in court, they usually will either reduce the fine or you can ask to not have points put on your license.

There are no points on your license and insurance isn't notified. They don't have proof you were driving the car just from the camera ticket. (damn cameras) lol. They also don't reduce the fine. It really isn't worth taking the time off of work for $25.
I'm just going to pay the full $75 but like I said-it's the point lol

they told me I have to go to court to fight it

which is not happening....it's not worth the $25 to take the time off from work
