I hate to say it, but yes. Why not get what is due to you. You guys will survive at work, they will hire someone else, but this is her life - she needed the $ and benefits. She could have given a bit more notice thought...

You are entitled to NYS disability even if you dont come back and most jobs payout unused vacay if you leave so its not really necessary to pretend your coming back if your not.
I do believe something people think they are coming back - but once they are home with LO they change their mind.

What about jobs that use sick time to pay you during your maternity leave, but do not give you a payout on that time if you tell them you aren't coming back prior to giving birth? For some people that can be weeks of full pay they'd miss out on otherwise.

People told me to do this, and I just couldnt.
I know I am not coming back to work and I told my boss that. He needs to replace me and I just couldnt do that. I will not get my maternity leave or any vacation due to me. But I just felt wrong going about it any other way.
But thats just me.

I wouldn't/couldn't do that. I have been with this job for 9 1/2 years and wouldn't do that to my boss or my co-workers.
If during my maternity leave i realized I really did not want to go back to work I would talk to my boss about it to make sure an adequate replacement could be found for me and offer to come in until a replacement is found and train the new person.
I would do the same...
