Maternity leave question?
I am not a teacher but I work for a nassau county school district. I plan on working until the end. My due date is February 21st. I know I can use my sick time before FMLA kicks in but wanted to know if I can use my vacation time before I use the sick time. I want to try and get paid as long as possible before having no money. its really tough for me and DH right now as he is in between jobs. Also do you get paid for the 6 or 8 week? I plan on being out the full 12 weeks FMLA allows. Sorry to all my questions Iam a little confused on how it works. Thanks.

Not sure about using the vacation (I'm a teacher and we don't have vacation days). As for the 6 or 8 weeks, that depends on the type of birth you have (vaginal vs. c-section) and how long you will be under the doctor's care following birth. If you have birth complications and are under the doctor's care for 12 weeks than you could conceivably be paid for the entire FMLA period IF you have the sick time accrued at your job and your doctor writes a note stating you are under his care.

Not sure if i'm answering your question, but FMLA does not pay you...it's purpose is to protect your job for up to 12 weeks.
You will be able to collect NYS disability payments which aren't much at all but you can get them for the 6 or 8 weeks you are allotted.
You can also get short term disability payments if that's part of your insurance package. Each STD ins carrier has a waiting period that can range anywhere from 1 - 8 weeks so after your waiting period is up you will be able to collect 60% pay for the remaining time. But keep in mind that if you have 6 weeks for a vaginal birth and a 4 week waiting period on your STD ins then you will only get 2 weeks of STD payments (minus the NYS disability payment) and 6 weeks of the NYS disability.

Yes--the 6 or 8 weeks is whether vag. or c-section, and that is the only period where you can use sick days. I was a v-birth, and work for NYS, so I could use my sick time during that 6 weeks. I could not use vacation time before using accrued sick (but I don't know why you would want to...). After those 6, I used vacation or unpaid for the remainder of my leave.

Thanks ladies!! Here at my job we have to use all our vacation up before the end of June I only have 11 days left. We get new vacation July 1st. I just dont want to lose it. So maybe I will use it after my maternity leave the 6 to 8 wks.
