Refinance and titles
DH and I are trying to refinance right now. The other day mortgage broker called and said since my name changed (we bought the house 3 months before we got married) I have to get a new title. Anyone know if this is true? TY

did you change it legally...SS#? We bought our house 3 months before we got married also. We just refinanced and the house is still under my maiden name because I use DH's last name and changed it on my license but never changed my SS card. Why? I dont know...I guess I never got around to doing it

You don't need a new Owner's Policy. The title policy will cover you through the date you bought the house for as long as you and you're DH own it.
But what you may want to do is a deed change. You probably want to change you name on the record and also the tenancy (husband and wife own property as tenants by the entirety. It allows it to pass right to the surviving spouse.) {If you have any questions about this, you should contact the lawyer that represented you when you purchase.}
Regardless of whether you do a deed change, the title company needs to see your legal proof of name change (aka your marriage certificate).
If you don't do a deed change, the mortgage can be done as ~ Mary Marriedlastname fka Mary Maidenname.
I also think that the mortgage broker might mean that you need a deed change and not new title. I have been working in the Reading & Clearance end of a title company for about 10 yrs and I have found that a lot of brokers really don't understand the title end of it.
Also, the title company will be issuing a Loan Policy for the new mortgage. So there will be a new title search done. It always needs to be done to the current date.
