Day care mandating flu shot vaccine - Can they do that ?
A friend of mine was telling me that his daughter's day care told them that the children MUST get the seasonal flu shot by January 1st.
I thought that they couldn't do that ?! Even if it's not NYS regulation, can daycare's make their own regulations like that ?
Any help would be appreciated so he can go to the school and talk to them about it. He's not against giving the vaccine, but his peds office doesn't have it, and they aren't planning on getting many in any time soon.

I believe they can do that. It is a private institution and you have a choice rather you want to go there or not. At DS's daycare we had to have all the shots up to date, we could not space them out if we wanted him at this daycare. I know it sucks but the daycare has that right.

wow ! I didn't think that the day care could mandate something that NYS and the CDC aren't even mandating !! That's crazy IMO.

yes, if it is a private center they can do as they please. I think its a great idea personally, but Im not anti-vaccines with the exception of children with egg allergies.

I think they can require it.
However there has to be some exception if they can't get it due to the supply
ETA: ours only requires the MMR & Dtap but not 'when'. They harassed me for her shots at 1yr but she was sick that week so she couldnt. They forgot but let me off the 'hook' once they realized why there was a delay.
I dont take the flu shot and neither does she. I would definately be upset if they forced it on us. I am not anti-vaccinations but i am against more than 2shots in a visit. I follow the CDC by using their guidelines for the 'age range' of shots. The flu shot however I do honestly believe it makes you sick (or can at least) and its not a risk I'll take.

Get a lawyer. You do not HAVE TO give your child the seasonal flu shot, for that matter, you do not HAVE to vaccinate your child at all.

no you don't but there is no reason to get a lawyer./..find another school that does not require the vaccination.
Private schools are allowed to mandate vaccines if they want to, it is perfectly legal

no one is saying they have to, they are just saying if you go there you do. If not you are free to not vaccinate and find another center. Talk about being lawsuit happy in this countyry.

I know in NJ all kids until Kindergarden must receive the flu shot unless it is due a medical or relgious exception. The director of my children's school requires a note from the Dr. stating that the children received the shot by Dec. The health department checks the records (I'm not sure if it is every year though).

This is daycare, not a public school, they can choose to mandate stand on your head Wednesday if they want!
Actually, I'd be shocked if an attorney would take this, it is a totally frivolous suit

Not to start... but can the parents of a child who truly cannot get the shot due to allergies or better yet THE POOR BABIES UNDER 6 MONTHS OF AGE in daycare (like my little one), sue the parent's of the child who brings the flu into the center just b/c they didn't want to do it but there was no MEDICAL reason not to? Such a lawsuit society!

If it's a matter of the pediatrician not having the shot, contact the Dept of health or find a clinic that does have it. You don't have to go through your pediatrician. There are lots of flu clinics this year.
Not trying top be a $-hit stirrer, but as someone who's infant will be starting daycare before he can obtain such vaccinations, I have to agree with clwp. I know people don't like it when their hand is forced when it comes to vaccines, but these diseases are so dangerous for the little ones. I also agree that people need to stop lawyering up. However, this wasn't the point the OP was trying to make. It was just a matter of finding a vaccine.
