My tenant the turd-update

It looks like he moved out. No December rent has been paid and my keys have not been returned.

I think I will have to sue is azz..

Something called abandonment..legal issue in AZ.

All he had to do was pay his rent and leave me the freakin keys.

Now I'm going to have to sue him which is really going to suck.

I wonder in this situation what legal grounds you have to re-rent the apartment with him still in possession of the keys.

You bring up a good point regarding abandonment. How long does he need to be "gone" for in order for you to re-rent the unit?

What happens if he comes back say on December 31st. Couldn't he theoretically come after you for changing the locks and breaking the lease? Well granted he already broke the lease by not paying, but you get what im saying right?

I sent the letter giving him 5 days to tell me what he was doing. I have not gotten the return receipt back yet.

I'm hoping the douche will just send me what he is supposed to and call it a day.

I have someone on sight there investigating whether he rented another condo in the complex. She is going to see if his car is somewhere else.

Abandonment is a legal issue in AZ and the complex told me I have done everything right so far and I should call a lawyer. I have the number but will give him a day or two to see if he pays and sends me the keys.

Typically he has paid me a piece of the rent by the 15th and the rest by the 25th.

The fact that he is ignoring calls and people knocking on his door makes me angry and I'm ready to sue him for more than just December rent.

I just hope it doesn't cost me in the end.

He verbally told my father he was moving out Dec 5. I've been trying to contact him by phone since November 21, after I received a note from him saying he was moving out within 60 days and he would let me know.

I know where he works. I hope he knows that if I win a lawsuit and he owes me money and can't pay, his wages will be garnished.

No more miss nice girl.

He finally emailed me yesterday.

He said his job is in bad shape and he took a major pay cut. He's moving in with a friend and paying $455 a month. He is getting the money from his parents for the December rent he owes us and has hired a cleaning person who is bonded and insured to clean the place when he leaves. He is 90% moved out.

He said he didn't call us back because he didn't want a confrontation and the stress he has been getting from collection agency calls was stressful enough. He said he has never been in this situation before where he couldn't pay his bills.

I understand.

If he would have just told me all of this two weeks ago it would have saved me the stress of not knowing what was going on in my own property.

I would not have sent him the letter.

I don't even know if he got the letter.

I haven't written him back yet.

Finally you have some sort of answer to whats going on. I would go by his word and if he doesnt do anything by Jan 1 then I would take it to court.

You should defintley write him back ASAP...and save all of your emails!!

yeah, I really don't believe half of what he says but he is spinning quite the web.

My agent there tells me a moving van was there a week ago Sunday and when you peek into the apt it looks like someone doesn't live there.

Either way, I will have pictures of the place and everyone who works in the complex is on it for me.
