**small update:
I just got a text message from my REA (after I had texted him this am to tell him that since I hadn't heard we were on for tomorrow I was canceling and that DH and I want to see more houses this weekend, because this one doesn't seem to be working out, but we weren't def. walking away) And he said that he will know for sure by 5, but to go ahead and schedule tenatively a home inspection for sunday at 12 or 1. Chat Icon I'm glad we have progress but I'm not scheduling to have to cancel again. Its a sunday, they guy has a family. I would HATE for him to plan to take time away from his family and find out again at the last minute that I need to cancel. And was it the fact that we're ready to move on, that suddenly we can inspect it???? Chat Icon

I really didn't want to post about any more house drama, but it seems I just can't escape it!! I really feel so annoyed!

so we found another house, and its perfect. Everything we wanted in a forever home, in a great area, and exactly the price we wanted to spend.

We put an offer in and it was accepted 2 weeks ago.

They are in the middle of getting a CO for an glass room they added onto the back of the house.

Our offer was accepted over 2 weeks ago and we still have NOT been allowed to do a home inspection. The house is in excellent condition except the 2 car garage. They had an apartment in there and are in the process of turning it back into a garage. They are older so they are having a contractor do all the work. Its really no big deal to us because its the garage.

The town came to do the inspection for the co and supposedly won't give them the co until the garage is put back. Chat Icon maybe, just maybe they made it a legal apartment, but I'm not really sure. They are also grieving the taxes. so maybe it has something to do with that?

Anyway, they don't want us to do a home inspection because they want the garage completely done. Well its been 2 weeks and we're not in contract yet. We even have an appointment for tomorrow for a home inspection because they said it would be done, and they have to cancel AGAIN.

Their REA says they are "older" and don't understand that our inspector is different then the town's inspector. The guy is no older then 60. He takes a train to NYC everyday and works a hard manual labor job. If you can do all this, I feel like there is no way you can't comprehend a home inspection. It is the only home they have ever lived in but still.

I told my REA that we're not walking away but I want to see more houses. I want to buy a house, and I don't want to keep playing games!!

Is this odd? Did anyone else have to wait for a home inspection?? DH and I feel like there isn't a darn thing they could be trying to fix and hide because the house is all updated and in really great shape... What the heck???Chat Icon
sorry I just can't take all the house stress anymore. I'm seriously about to give up!!!!

oh and btw- we put a closing date of nov 1 on the offer they accpeted, and now they are telling us it might be dec or Jan before they can move out. who accpets an offer when you know you can't possibly move out by then??? (they are building a house in NC and it won't be ready) which isn't the end of the world, but we are going to lose the 8K which bothers me a little but its kinda worth it for this house. but they shouldn't have accpeted that offer with that closing date!! in anger I told my REA to let them know they will need to bring 8K in cash to closing if we don't close before nov 30 Chat Icon I know it will never happen but I can try! we had more then enough time (over 60 days) from the accpeted offer, to close in time and they knew we were going for the credit

it sounds weird to me. technically youre supposed to do the inspection within 48 hours of the accepted offer, or at least thats my understanding..

also, the inspection checks electric, heating and roofing. i dont understand why the living space/garage would be an issue. the inspector will just say that you need a CO for living space or convert it back to the garage. its not a pass fail thing, its to protect YOU. i dont understand why they would be stalling based on a CO.. sounds weird to me..

Sorry that you are having all this trouble.

As for the tax credit- I have heard quite a bit about it being extended- so it may work out- also I would check, our friends who are buying now told us that you had to be in contract by 11/30/09 to get the credit- I am not sure you have to be officially closed.

i hope they do extend it, but really I would be willing to lose the 8K if it works out. As far as the IRS website, you have to CLOSE by nov 30, as of now.

We LOVE this house! we really want it, but I just don't understand the games! I wish there was something else we could do, to get ourselves in contract with them Chat Icon Chat Icon

ugggggggggggggghhhh!! I feel for you!

First off a closing date is always an on or about date when it's in the contract. It's not set in stone, unless you put a time is of the essence clause in your contract which is rare. Here there is no contract so the date can be changed. When they send out the contract to your atty they will include that on or about date of closing. It's up to your atty to accept or not or try to come to an agreement on another date if the date they chose is too long for you.

As for the inspection, I would tell them that it needs to be done by _______ or you're walking away. It's ridiculous that they're holding you up. God forbid your inspector finds something and you back out in the end--you've wasted your time. An inspection is usually done within in DAYS of the offer being accepted.

ton's of seller's pull this kind of stuff. there are reasons behind it and seriously the REA is full of you know what. they work for the seller and know exactly what is going on and what their intentions are. don't trust anyone.

it's 8,000 so to not risk losing it, go to your lawyer and have the contract amended to say that you have to close before 11/30/09 or the price drops 8,000 to cover you. don't throw that money away because the sellers are being lazy and are slow because they want their house built in time to make an easy move to NC.

we had signed 5 contracts on houses we loved and thought were the ones for us and every seller played a game with us. after seeing the tricks people pulled we learned fast and had no BS with our current home. only problem was the sellers stalled for no reason whatsoever (house was empty) and we got married right before closing and ended up losing the tax credit bc I'm not a 1st time buyer (wife is). so annoying, i wish i had put a clause in my contract to say they need to close before our wedding or the price drops.

odd, my inspection was 10 after the offer was accepted.

Only reason it wasn't sooner was because weekend before was Orthodox Easter - former owners were Greek
