co-op board - need help!
i ive in a co-op community. i purchased my apt 3 years ago. our apartements do not come w/ available parking. i waited on a list for over a year before i was assigned a spot - which is about a block and a 1/2 away and i pay $55 a month for.
last week i took my car to the carwash to discover that my paint is ruined. - the tree that hangs above my spot began dropping those pin oaks (the green propeller looking leaves). my car would daily be covered in these leaves. i thought nothing of it - until i saw the brown stains all over the vehicle. they are on the hood, the trunk, the doors, the roof, - its horrible. they are clearly in the shapes of these propeller leaves - so there is no denying this is the cause.
i immediately brought my car to a local body shop. they said they can try to do a wet sand - which is where they remove the glaze clean the stains and than reglaze - but if that doesnt work they will have to repaint the vehicle.
i called maintenance office and i requested that my spot be changed immediately. the woman told me she wanted to see my car.
i had a woman come out w/ a handiwipes trying to wipe the stains off and telling me to get "compound". ive now brought my car to 2 car cleaning professionals and this one in an office is telling me compound is going to fix everything?? they treated me as if i was a jerk. totally tried to minimialze the problem. the woman told me that only the board has the power to change spots and it woudl have to be brought to their attention.
i took pictures, wrote a well worded letter, and included the quote from the body shop. i asked the board to change my spot immediately. i handed this packet to the mgmt office the same day.
this morning i called - since its been 1 week since i submitted the information and was told the board will not be responsible for the cost of the vehicle and they cannot move my spot since there are parkign rules. i can place myself again on the waitling list. they did say that they will cut back the branches so the leaves stop falling.
im not satisified with this answer. i dont know what else to do. is there any other route i can take? any advice on dealing with a stupid board?
i think im also frustrated because so many people in my community are sublets and im an actual shareholder. i feel like im always getting assesed for something and now my car is damaged because of a stupid tree on the property that i pay to maintain and they cant even MOVE my car w/o a song and a dance. this is an extreme circumstance IMO.
im just so frustrated. what can i do?

You can start by sueing the cooperative. Why waste time with phone calls that go unanswered?
You have the damages and can prove them. So drop a small claims lawsuit on them. That will get their attention.
Just keep in mind it is very likely that there is a clause in your proprietary lease that essentially says you park at your own risk.
But to me that wouldn't matter and I'd sue them anyways. But that's just my opinion as I am the type of person that doesn't play games.

If your board in uncooperative, its time to go to small claims court...file a claim against them and for the damages. At the hearin, request that the judge orders the board to give you a new spot.
I can't believe what you're dealing with! JERKS!!!!!!

I agree with the above posters...
Co-ops can really suck sometimes. I lived in one for 3 years. I couldn't stand all the "rules".
Good luck!

I live in a coop too and agree with what everyone is saying about small claims court- but aren't you essentially suing yourself if you sue them? I am wondering if maybe you can have an attorney send a letter to the board to move things along? If you have any friends or family members that are attorneys I would try that route first

Are you suing yourself? Nah.
The co-ops should have plenty of cash reserve to easily write something like off.
And besides, that's what insurance is for (their insurance).

Re: co-op board - need help!
tell them to cut the darn tree down or move it - whichever is cheaper so u can keep your spot and so it doesnt happen to someone else who parks there OR u can buy a car cover. just suggestions if you dont want to go to small claims court
