Security Deposit on Apartment
So I'm renting a house and my lease is up on the 1st... My landlord said he can't give me my Security Deposit back until the 15th. He want's to post date the check for the 15th. Is the legal? He told me that technically he has 30 days.. Is he correct? FWIW: I gave him a 45 day notice and I really need my security deposit back so I can put it on my new place.

Re: Security Deposit on Apartment
I don't think he has to give you the security deposit the day you move out.
I could be wrong, but I believe there is a "grace period" similar to what he is describing to return the deposit.

Re: Security Deposit on Apartment
It always takes a few weeks to get it back...usually after you move out they inspect the place and then return it to you
I have never used it to put down on the next place....usually you have to pay for the new place before you move out of the old place

Yes legally he has 30 days....some states it is even longer I believe.
And he does not have to accept security as the last month rent so you cant even say just use it for rent.

I thought so but it reads on the lease agreement "The Landloard will return the Security after the term ends".

And that clause in the lease is probably read to be a reasonable time after which would be 30 days. If he is saying he will have it to you in 15-30 I really dont think you can fight it if you did it would take linger than that to go through court.

"After the term ends" could mean any time after the lease ends. I don't think I ever waited the full 30 days for the deposit to be returned but it's pretty standard.

Re: Security Deposit on Apartment
When we moved out of our appt complex we were told 30-60 days. We got it in exactly 30 days. Our current landlord (renting a house now) our lease says 30 days.
