sorry you are going through this

we went through a similiar situation

i agree the date in the contract doesn't really mean much unless it states "time is of essence".. BUT they really aren't doing you a favor. if they aren't ready to close their problem. what would they do if they had to find another buyer & go through the whole process again. our rate expired and the sellers weren't even ready to close. they wanted US to pay the fee. i said no
F ****ing way. in the long run we won that battle. we closed on a wednesday & got possession that friday. i understand maybe 2-3 days of not paying rent. but 2 weeks? i really would look into that. That is YOUR house when sign the papers at closing. i would go through everything very carefully once they vacate

i know its a BIG pita but it will all be worth it !!

I think there is some confusion in this thread.

The sellers aren't closing and then demanding to live there for a month.

They are simply delaying the closing based on the contract's "on or about date".

Big difference. The first never happens. The latter happens often.



I think you have it wrong. The way i understood it is they all ARE closing because the buyers got a good rate, the sellers are staying one month POST closing b/c they did the buyers a favor for closing on monday, when they weren't ready. So, they close, and buyer owns home for one month while the sellers live in it... while only 2500.00 is in escrow.
my ATTY would have never allowed this, she always enforces to not leave $$ in escrow, it's too much of a PITA.



they aren't staying for one month past closing, just 1-2 weeks.

they are doing us a favor by not delaying closing - as a PP said, the sellers do NOT have to close just to save US our rate lock!

I understand whats going on but I think your atty worked out this deal thinking you'd be cool with it since tchnically they are doing you a "favor" This is NOT a legal based arrangement. Technically you own the house as of 9/1 or whatever your closing date is.

you're right - it looks like there won't be anything in writing. but because this was a discussion between the attorneys i have no problem threatening legal action if it comes to that.

WE did the same thing when we closed on our house.

We had until 10/15 to close and we werent closing on the new house until November so really we wanted to take our time...

But the new owners had a rate lock which was about to expire on Lets say 10/5 (I dont remember all the dates to be honest)

We agreed to close early but would stay in the house until 10/15 and pay nothing. Our contract had said we had to pay x amount per day for each day after #3. But this was agreed upon by all parties prior to teh closing and at closing we signed an addendum to the contract stating we would be on premises until 10/15 but be paying no "rent"
