 Unemployment question 
Does anyone know if getting arrested and staying in jail for 2+ months would be reason to not receive unemployment.  Is that like voluntarilly quitting or Misconduct Discharge?  It was for a weapons charge, the arrest.

  In NY this person would not be able to collect UI while in jail because they wouldn't be "willing and able to work"

I would assume you can't collect...  To be eligible to receive unemployment, you need to be actively seeking a job and able to start working...  You can't do that while in jail.

Sorry, the person has been released from jail.  Did not returned to work because the employer has clients who know what happened and do not want them on their job.  They filed for unemployment 2 months after being released from jail.

  If the boss laid him off he could collect, of course boss could protest his collection if he wanted to and then a hearing would be held.
  Just having a record doesn't prevent one from collecting UI

  I'm assuming he worked out a leave of absence with his boss and didn't just stop showing up.
  If he abandoned his job then no he couldn't get UI.

He did just stop showing up because he was in jail lol.  Couldn't get out to go to work.
  there was no leave of absence the boss just knew he was in jail and had no idea when he would be released.  When he called to see if there would be a job for him when he was eventually let out of jail the boss told him that the clients didn't want him there and that he would not be employed any further.

My dh had an ex-employee that stopped coming to work because he was in jail. I got a letter from from unemployement saying he tried to put in a claim n iwrote a letter and sent copies of his employee file. A few weeks later I got a letter saying his claim was approved
