Does anyone know (question about maternity benefits)
How long your employer HAS to hold your job if you go out on disability maternity and non maternity ?

At my firm, depending in how many years you are with the firm depends on how many full paid weeks you get. The firm is entitled to hold you a job but not your position for that amount of weeks.

They have to give you FMLA (by law) (family Medical leave Act) equalling 12 weeks (doesn't have to be paid) if you have been with the company for at least 1 year. The 12 weeks includes time you take before or after birth (disability time included). Anything after that is determined by the company (whether longer time allowed, what is paid, etc). Hope this helps

Only FMLA guarantees you a post (not necessarily income!). It's a total of 12 weeks per calendar year.

FMLA is only if your employer is required to by law.
FMLA applies to all public agencies, all public and private elementary and secondary schools, and companies with 50 or more employees.
If you work for a small company, work under 1,250 hours in one year, have been there less than a year, you're out of luck.
Also they have to hold a job. That's not to say they can't fire you when you come back.

I just want to add that they have to hold a position, not necessarily your position. They can put you someplace else as long as it is comparable to the position you left.
